12 LONG TITLE
13 General Description:
14 This bill addresses issues related to the 17th Amendment to the United States
15 Constitution and permits the Legislature to provide counsel to United States Senators
16 representing Utah and to receive certain reports from them.
17 Highlighted Provisions:
18 This bill:
19 . allows the Legislature to provide counsel to a United States Senator elected from
20 Utah;
21 . allows the Legislature to request that United States Senators elected from Utah
22 report to the Legislature on certain issues determined by the Legislature;
23 . provides that any counsel or requests for reports be made by S. a resolution or
23a statement called "The Sense of the Senate" that is issued by .S :
24 . a joint resolution of the Legislature; or
25 . a written statement S. [
26 signatures of a majority of the members of the House and a majority of the
27
28 . directs the Office of Legislative Research and General Counsel to maintain a record
29 of all resolutions, statements, and responses issued under this section.

41 Be it enacted by the Legislature of the state of Utah:
42 Section 1. Section 36-27-101 is enacted to read:

44 36-27-101. Title.
45 This chapter is known as "Legislature's Counsel to U.S. Senators."
46 Section 2. Section 36-27-102 is enacted to read:
47 36-27-102. Legislative counsel addressed to U.S. Senators.
48 (1) The Legislature may provide counsel to United States Senators representing Utah.
49 (2) The Legislature may request that United States Senators representing Utah provide
50 a single response or periodic reports to the Legislature on:
51 (a) each senator's progress with or response to the counsel given under Subsection (1);
52 or
53 (b) other issues as determined by the Legislature.
54 Section 3. Section 36-27-103 is enacted to read:
55 36-27-103. Resolution of the Legislature -- Statement providing sense of the
56 Legislature.
57 (1) The Legislature may provide any counsel or reporting requests under Section

by:58
59 (a) passing a joint resolution of the Legislature; or
60 (b) issuing a written statement that contains the signatures of a majority of the
61 members of the House and a majority of the members of the Senate.
62 (2) A written statement under Subsection (1) S. [

64 Section 4. Section 36-27-104 is enacted to read:
65 36-27-104. Issuance of resolution or sense of the Legislature -- Reporting
66 requirements.
67 (1) (a) Any resolution or sense of the Legislature that is issued under this chapter shall
68 be sent to each United States Senator representing Utah.
69 (b) A copy of any resolution or sense of the Legislature that is issued under this chapter
70 shall be sent to Utah's Representatives to the United States Congress.
71 (2) Each resolution or sense of the Legislature issued under this chapter shall specify
72 that United States Senators representing Utah shall provide the following to the Office of
73 Legislative Research and General Counsel when submitting a report in response to the
74 resolution or sense of the Legislature:
75 (a) prior notice of any verbal response or report; or
76 (b) a copy of any written response or report.
77 (3) The Office of Legislative Research and General Counsel shall maintain a record of:
78 (a) all resolutions and senses of the Legislature issued under this chapter; and
79 (b) all responses and reports provided to the Legislature by a United States Senator in
80 response to a resolution or sense of the Legislature issued under this chapter.
