             9      LONG TITLE
             10      General Description:
             11          This bill requires that if an animal shelter must euthanize an animal, the animal shelter
             12      shall euthanize, with certain exceptions, the animal by lethal injection and sets
             13      requirements for euthanization in a carbon monoxide chamber.
             14      Highlighted Provisions:
             15          This bill:
             16          .    requires that an animal shelter euthanize an animal, with certain exceptions, by
             17      lethal injection;
             18          .    sets requirements for euthanization in a carbon monoxide chamber; and
             19          .    makes technical corrections.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Section 10-17-108 is enacted to read:

CHAPTER 17. MUNICIPAL ANIMAL SHELTER ACT

             32          10-17-108. Euthanasia.
             33          (1) As used in this section, "animal" means any animal accepted by an animal shelter.
             34          (2) S. (a) .S If an animal shelter must euthanize an animal, the animal shelter shall S. ,
             34a      except as provided in Subsection (2)(b), .S euthanize the
             35      animal by lethal injection H. [ , unless: ] or carbon monoxide chamber. S. (b) Subsection (2)(a)
             35a      does not apply to an animal that must be euthanized outside of the animal shelter's place of business or
             35b      facility by an animal control officer who:
             35c                  (i) contracts with the animal shelter; and
             35d                  (ii) must euthanize the animal in an emergency situation. .S
             36           [ (a) the animal presents a danger to staff performing the euthanization; or
             37          (b) a restraint required for lethal injection will cause undue stress on the animal.

             38          (3) (a) If an animal is euthanized under Subsection (2) H. [ (a) or (b) ] .H in a carbon
             38a      monoxide
             39      chamber, and except as provided in Subsection (3)(b), the animal shelter may not euthanize
             40      more than one animal at a time in the carbon monoxide chamber.
             41          (b) An animal shelter may euthanize more than one animal at a time in a carbon
             42      monoxide chamber if:
             43          (i) the carbon monoxide chamber has multiple compartments or chambers designed to
             44      hold one animal per compartment or chamber; and
             45          (ii) no more than one animal is placed in each compartment or chamber.
             46          (c) An animal shelter may not use a carbon monoxide chamber for animal
             47      euthanization unless:
             48          (i) the carbon monoxide used by the shelter is commercially compressed; and
             49          (ii) the animal shelter has adopted safety guidelines for the use of carbon monoxide.
             50          Section 2. Section 17-42-108 is enacted to read:

CHAPTER 42. COUNTY ANIMAL SHELTER ACT

             52          17-42-108. Euthanasia.
             53          (1) As used in this section, "animal" means any animal accepted by an animal shelter.


             54          (2) S. (a) .S If an animal shelter must euthanize an animal, the animal shelter shall S. ,
