             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Election Code by amending provisions for early voting for certain
             10      municipalities.
             11      Highlighted Provisions:
             12          This bill:
             13          .    allows rather than requires a municipality of the fifth class or a town to provide
             14      early voting for a municipal primary election or a municipal general election; and
             15          .    makes technical changes.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 20A-3-601 is amended to read:
             27           20A-3-601. Early voting.


             28          (1) A person who is registered to vote may vote before the election date in accordance
             29      with this section.
             30          (2) (a) The early voting period shall begin on the date that is 14 days before the date of
             31      the election.
             32          (b) Early voting shall continue through[: (i)] the Friday before the election if the
             33      election date is a Tuesday[; or].
             34          [(ii) the date that is two regular business days before the date of the election if the
             35      election date is a day other than Tuesday.]
             36          (c) During the early voting period, the election officer:
             37          (i) for a local special [elections,] election, a municipal primary [elections] election, and
             38      a municipal general [elections] election:
             39          (A) shall conduct early voting on a minimum of four days during each week of the
             40      early voting period; and
             41          (B) shall conduct early voting on the last day of the early voting period; and
             42          (ii) for all other elections:
             43          (A) shall conduct early voting on each weekday; and
             44          (B) may elect to conduct early voting on [Saturdays, Sundays, or holidays] a Saturday,
             45      Sunday, or holiday.
             46          (3) Except as specifically provided in this Part 6, Early Voting, early voting shall be
             47      administered according to the requirements of this title.
             48          Section 2. Section 20A-3-605 is amended to read:
             49           20A-3-605. Exemption from early voting for a local district election -- Optional
             50      early voting for fifth class municipality or town.
             51          (1) This part does not apply to an election of a board member of a local district.
             52          (2) Notwithstanding the requirements of Section 20A-3-601 , a municipality of the fifth
             53      class or a town as described in Section 10-2-301 may provide early voting as provided under
             54      this part for:
             55          (a) a municipal primary election; or
             56          (b) a municipal general election.
