             7      LONG TITLE
             8      General Description:
             9          This bill creates a restricted special revenue fund to allow state archives to use
             10      donations for state archive purposes.
             11      Highlighted Provisions:
             12          This bill:
             13          .    defines terms;
             14          .    creates the State Archives Fund, as a restricted special revenue fund;
             15          .    specifies what is deposited into the fund and uses of the fund;
             16          .    provides that the fund shall earn interest; and
             17          .    provides that state archives shall report on the use of the fund as part of the annual
             18      budget process.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Section 63A-12-100.5 is amended to read:
             31           63A-12-100.5. Definitions.
             32          [The] (1) Except as provided under Subsection (2), the definitions in Section
             33      63G-2-103 apply to this chapter.
             34          (2) As used in this chapter, "division" or "state archives" means the Division of
             35      Archives and Records Service.
             36          Section 2. Section 63A-12-109 is enacted to read:
             37          63A-12-109. State Archives Fund created -- Donations -- Use of money --
             38      Reporting.
             39          (1) There is created a restricted special revenue fund known as the "State Archives
             40      Fund."
             41          (2) The fund consists of money or other assets deposited in the fund from:
             42          (a) a donation;
             43          (b) a deposit;
             44          (c) a contribution;
             45          (d) a gift;
             46          (e) an endowment;
             47          (f) a devise; and
             48          (g) a bequest of real property, personal property, or service.
             49          (3) The division shall use the fund money for:
             50          (a) the purpose specified by the grantor, if any; or
             51          (b) if no purpose is specified by the grantor, the preservation of and access to the
             52      archival records and exhibits.
             53          (4) (a) The fund shall earn interest.
             54          (b) The state treasurer shall deposit all interest earned on money in the fund into the
             55      fund.
             56          (5) The division shall annually report on the use of the fund to an appropriation
             57      subcommittee designated by the Executive Appropriations Committee as part of the
             58      appropriation subcommittee's budgetary process under Title 63J, Chapter 1, Budgetary

             59      Procedures Act.
