Chair Waddoups called the meeting to order at 10:17 a.m.

Committee Business



The Analyst gave a presentation on the use of nonlapsing funds as the law provides in 63-38-8.1 Utah Code Annotated.

MOTION: Rep. Bush moved to adopt the following intent language:



National Guard



Under terms of Section 63-38-8.1 Utah Code Annotated, Item 240 of Chapter 334 Laws of Utah 2001 is made nonlapsing with the use of any nonlapsing funds limited to the following:

Schedule of Programs:

Armory Maintenance 50,000

Veteran's Cemetery 50,000



Department of Transportation



Under terms of Section 63-38-8.1 Utah Code Annotated, Item 240 of Chapter 334 Laws of Utah 2001 is made nonlapsing with the use of any nonlapsing funds limited to the following:

Maintenance: 500,000

The motion passed unanimously.



Chair Waddoups invited the Department of Environmental Quality, Utah National Guard, and Utah Department of Transportation to respond to questions asked by the committee at the previous meeting.



Department of Environmental Quality



Dianne Nielson, Executive Director of the Department of Environmental Quality, suggested alternatives to the $32,000 of furlough. $25,000 of general funds could be saved by using staff instead of contract labor in the local studies of drinking water. $7,000 could be taken from out-of- state travel. Brent Bradford assisted in answering questions from the committee.



Utah National Guard



The Analyst suggested new recommendations for the National Guard and answered questions from the committee. The reductions for Armory Maintenance change from $200,400 in the General Fund to $20,300 for a difference of $180,100. Veteran Affairs reductions will change from $9,300 to $4,000 for a difference of $5,300. The reduction for the Veterans Cemetery will change from $11,500 to $5,000 for a difference of $6,500. To accomplish this, the ongoing general funds budget in airport construction would be changed from $200,000 to $0.



Utah Department of Transportation



John Nord addressed airport maintenance concerns if the $200,000 were taken out of aeronautics. He stressed the importance of Utah's 50 airports and explained their needs for maintenance and security. He then answered questions from the committee.

Dianne Nielson responded to the suggestions that the administration of the DEQ be consolidated to absorb the monies for airport construction. She expressed the need for the current

administration. Brent Bradford assisted in answering questions from the committee.



The Chair ruled to make the following votes tentative.



MOTION: Sen. Peterson moved to accept the recommended FY2002 budget reduction of $372,300, replacing the furlough for the DEQ with other budget adjustments in local drinking water studies and out-of-state travel.



SUBSTITUTE

MOTION: Rep. Harper made a substitute motion to accept the Analyst's recommendation for a reduction in the DEQ budget for FY2002 of $372,300 plus an additional $90,000 from general funds to be identified by the DEQ for a total of $462,300. The motion passed, with Sen. Peterson, Rep. Clark, Rep. Hendrickson, and Rep. Young voting in opposition.



MOTION: Rep. Harper moved to approve the Analyst's recommendations for reductions in the FY2002 budget for UDOT of $111,200 plus and additional $93,400 in General Funds from Airport Construction. The motion passed, with Rep. Murray and Rep. Young voting in opposition.



MOTION: Sen. Peterson moved to request that the Analyst try to find $110,000 of General Funds for the Airport Construction budget in FY2003 to restore the ongoing General Fund appropriation. The motion passed, with Sen. Spencer voting in opposition.



MOTION: Sen. Peterson moved to accept a General Fund reduction in the FY2002 budget of $38,500 for the National Guard. The motion passed, with Rep. Young voting in opposition.



MOTION: Sen. Peterson moved to adjourn the meeting. The motion passed unanimously.



Chair Waddoups adjourned the meeting at 11:43 a.m.
