Line Item: Grand Jury

Function

The Legislature enacted the Grand Jury Reform Act that created a separate budget item for this purpose. The budget exists as a vehicle to pay Grand Jury expenses when one is convened. The Act also authorized a Grand Jury Prosecution budget. These two items were combined for presentation on a year-to-year basis.

Statutory Authority

UCA 77-10a-20 creates a separate line item for grand jury expenses and authorizes payment of those expenses, as well as the expenses of a special prosecutor, when used.

Intent Language

Under Section 63J-1-401 and 63J-1-402 of the Utah Code, the Legislature intends that any remaining funds shall not lapse at the close of fiscal year 2009.

The agency will be reporting on implementation of this intent language during the 2010 General Session.

Funding Detail

The line item receives a minimal appropriation each year and could be used to allocate supplemental appropriations when necessary.
