APPROPRIATION FOR SOUND BARRIERS

5 AN ACT RELATING TO APPROPRIATIONS; APPROPRIATING FROM THE
6 TRANSPORTATION FUND FOR FISCAL YEAR 1997-98, $5,000,000 TO THE
7 DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF CERTAIN
8 NOISE S [ WALLS] ABATEMENT MEASURES s ; MAKING THE APPROPRIATION
8a NONLAPSING; AND PROVIDING AN
9 EFFECTIVE DATE.
10 This act enacts uncodified material.
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Appropriation.
13 (1) There is appropriated from the Transportation Fund for fiscal year 1997-98, $5,000,000
14 to the Department of Transportation.
15 (2) It is the intent of the Legislature that:
16 (a) this appropriation shall be used for the construction of S RETROFIT NOISE ABATEMENT
16a MEASURES, INCLUDING s retrofit noise walls as prioritized
17 by the Transportation Commission; and
18 (b) the priority system for the construction of retrofit noise abatement measures shall
19 include:
20 (i) the decibel level of traffic noise at each location;
21 (ii) the number of residential dwellings adversely affected by the traffic noise;
22 (iii) the cost effectiveness of mitigating the traffic noise; and

25 (3) This appropriation is nonlapsing.
26 Section 2. Effective date.
27 This act takes effect on July 1, 1997.
