5    AN ACT RELATING TO PUBLIC SAFETY; CREATING TRANSITION PROVISIONS FOR
6    THE CHANGE IN CLASSIFICATION OF CERTAIN SECURITY PERSONNEL.
7    This act affects sections of Utah Code Annotated 1953 as follows:
8    AMENDS:
9         53-1-109, as last amended by Chapter 285, Laws of Utah 1996
10    Be it enacted by the Legislature of the state of Utah:
11        Section 1. Section 53-1-109 is amended to read:
12         53-1-109. Security for capitol complex -- Traffic and parking rules enforcement for
13     division -- Security personnel.
14        (1) The commissioner, in cooperation with the director of the Division of Facilities
15    Construction and Management, shall:
16        (a) provide for the security of grounds and buildings of the capitol complex; and
17        (b) enforce traffic provisions under Title 41, Chapter 6, Traffic Rules and Regulations, and
18    parking rules, as adopted by the Division of Facilities Construction and Management, for all
19    grounds and buildings under the jurisdiction of the Division of Facilities Construction and
20    Management.
21        (2) Security personnel required in Subsection (1), shall be peace officers as defined in
22    Section 77-1a-1[, or security guards as defined in Title 58, Chapter 63, Security Personnel

25    service with Protective Services within the Utah Highway Patrol Division as special function
26    officers, as defined in Section 77-1a-4, on June 29, 1996, shall become peace officers S :(a) s without a
27    requirement of any additional training or examinations S IF THEY HAVE COMPLETED THE ENTIRE PEACE
27a     OFFICER TRAINING OF THE PEACE OFFICERS STANDARDS AND TRAINING DIVISION; OR (b) UPON
27b     COMPLETING ONLY THE ACADEMIC PROTION OF THE PEACE OFFICER TRAINING OF THE PEACE
27c     OFFICERS STANDARDS AND TRAINING DIVISION s .

1        (4) An officer in a supervisory position with Protective Services within the Utah Highway
2    Patrol Division shall be allowed to transfer the job title that the officer held on April 28, 1996, into
3    a comparable supervisory position of employment as a peace officer for as long as the officer
4    remains with Protective Services within the Utah Highway Patrol Division.
