6    AN ACT RELATING TO HIGHER EDUCATION; PROVIDING THAT FULL-TIME
7    FACULTY AT HIGHER EDUCATION INSTITUTIONS MAY ENROLL IN GRADUATE
8    CLASSES WITHOUT PAYING TUITION IF SPACE IS AVAILABLE WITHOUT
9    INCREASING INSTRUCTIONAL COSTS; AND PROVIDING AN EFFECTIVE DATE.
10    This act affects sections of Utah Code Annotated 1953 as follows:
11    ENACTS:
12         53B-8-105, Utah Code Annotated 1953
13    Be it enacted by the Legislature of the state of Utah:
14        Section 1. Section 53B-8-105 is enacted to read:
15         53B-8-105. Tuition waivers for full-time faculty.
16        (1) Full-time faculty at the state's institutions of higher education may enroll in graduate
17    level classes for which they are qualified at any institution within the state system of higher
18    education without paying tuition and any other fee associated with those classes after:
19        (a) regularly enrolled students have been assigned and admitted to available classroom
20    space for the graduate level classes in accordance with regular procedures and normal teaching
21    loads for that space within the approved budget; and
22        (b) the institution has determined that space is available for the enrollment of full-time
23    faculty without increased instructional costs.
24        (2) The board shall adopt rules upon which the institutions shall base their space
25    availability and instructional cost determinations under Subsection (1).
26        (3) (a) Institutional enrollment reports shall show full-time faculty enrolled in graduate
27    classes under this section.


1        (b) Institutions may not count faculty as full-time students under this section.
2        Section 2. Effective date.
3        This act takes effect on July 1, 1998.
