COMMERCIAL WASTE FACILITY ISSUES

                  AN ACT RELATING TO THE ENVIRONMENT; PROVIDING FOR LEGISLATIVE STUDY
                  OF FEES, TAXES, AND SITING REGARDING COMMERCIAL WASTE FACILITIES;
                  AND APPROPRIATING $500,000 FROM THE DEPARTMENT OF ENVIRONMENTAL
                  QUALITY TO THE GENERAL FUND.
                  This act enacts uncodified material.
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Legislative study of commercial waste disposal issues.
                      (1) Since the Legislature has discovered significant issues related to commercial waste
                  facilities in the state, the Legislature finds a detailed analysis is in order related to fees, taxes, and
                  siting concerning these facilities.
                      (2) (a) It is the intent of the Legislature that during the 1998 Legislative Interim the
                  Revenue and Taxation Interim Committee shall study the issues of fees, taxes, and siting regarding
                  commercial waste disposal facilities in the state.
                      (b) This study shall be conducted under the direction of and in consultation with the
                  Legislative Management Committee, with the interim committee making a final report to the
                  Legislative Management Committee not later than October 31, 1998.
                      Section 2. Appropriation.
                      The Legislature appropriates for fiscal year 1998-99 $500,000 from the financial reserves
                  in the Department of Environmental Quality to the General Fund.
