6    AN ACT RELATING TO TASK FORCES; REAUTHORIZING THE JUVENILE JUSTICE
7    TASK FORCE; DEFINING ISSUES FOR STUDY; APPROPRIATING $35,750 FROM THE
8    GENERAL FUND FOR FISCAL YEAR 1997-98 FOR THE TASK FORCE; PROVIDING AN
9    EFFECTIVE DATE; AND PROVIDING A REPEAL DATE.
10    This act affects uncodified material as follows:
11    AMENDS:
12     Uncodified Section 5, Chapter 262, Laws of Utah 1996
13     Uncodified Section 8, Chapter 262, Laws of Utah 1996
14    Be it enacted by the Legislature of the state of Utah:
15        Section 1. Uncodified Section 5, Chapter 262, Laws of Utah 1996 is amended to read:
16        Section 5. Task force duties and responsibilities.
17        (1) The task force shall study the:
18        (a) [presumptive] sentencing matrix guidelines and their advantages and disadvantages;
19        [(b) resources needed to make the presumptive guidelines effective if adopted;]
20        [(c) fiscal impact and] (b) resources needed to operate the Division of Child and Family
21    Services, the Division of Youth Corrections, and the juvenile court to meet the needs of
22    delinquent, abused, and neglected youth;
23        [(d)] (c) purpose of juvenile justice, including the balance between rehabilitation [and],
24    treatment, [and] public safety, and juvenile accountability;
25        [(e)] (d) operation of secure facilities, and resources and facilities needed;
26        [(f)] (e) jurisdictional age of juveniles;
27        [(g)] (f) juvenile court minimum sentencing authority and the role of the Youth Parole


1    Authority;
2        [(h)] (g) reorganization or streamlining of placement, intake, and probation functions;
3        [(i)] (h) juvenile sex offender treatment; and
4        [(j)] (i) other issues the task force considers relevant.
5        (2) The task force shall report its findings and recommendations to either the Judiciary
6    [Interim Committee and], Law Enforcement and Criminal Justice, or Health and Human Services
7    Interim [Committee] Committees no later than November [1996] 1998.
8        Section 2. Uncodified Section 8, Chapter 262, Laws of Utah 1996 is amended to read:
9        Section 8. Repeal date.
10        This act is repealed December 31, [1997] 1998.
11        Section 3. Appropriation.
12        (1) There is appropriated from the General Fund for fiscal year 1997-98, $25,000 to the
13    Office of Legislative Research and General Counsel for staffing expenses associated with the task
14    force.
15        (2) There is appropriated from the General Fund for fiscal year 1997-98, $4,000 to the
16    Senate for salaries and expenses of senators who are members of the task force.
17        (3) There is appropriated from the General Fund for fiscal year 1997-98, $6,750 to the
18    House of Representatives for salaries and expenses of representatives who are members of the task
19    force.
20        Section 4. Effective date.
21        If approved by two-thirds of all the members elected to each house, this act takes effect
22    upon approval by the governor, or the day following the constitutional time limit of Utah
23    Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
24    date of veto override.
