MOSQUITO ABATEMENT DISTRICT AMENDMENTS

                  AN ACT RELATING TO SPECIAL DISTRICTS; PROVIDING THAT MEMBERS OF THE
                  BOARD OF TRUSTEES OF A MOSQUITO ABATEMENT DISTRICT MAY RECEIVE
                  COMPENSATION; MAKING TECHNICAL CORRECTIONS; AND PROVIDING AN
                  EFFECTIVE DATE.
                  This act affects sections of Utah Code Annotated 1953 as follows:
                  AMENDS:
                      17A-2-907, as last amended by Chapter 273, Laws of Utah 1991
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Section 17A-2-907 is amended to read:
                       17A-2-907. Board of trustees -- Organization -- Compensation -- Meetings --
                  Vacancies -- Quorum.
                      (1) (a) The members of the board of trustees shall:
                      (i) meet on the first Monday [after] that is at least 30 days after the certificate of
                  incorporation is [filed with] issued by the lieutenant governor; and
                      (ii) organize by electing one of their members as president [and], one as secretary, and
                  other officers as desired.
                      (b) [The members] A member of the board [shall serve without] may receive:
                      (i) total compensation[, except for the necessary expenses of each member for actual
                  traveling] of not more than $1,000 per year as determined by the board of trustees; and
                      (ii) reasonable mileage and expenses [on] necessarily incurred to attend meetings or
                  conduct business connected with the board.
                      (2) Any vacancy on the board shall be filled as provided in [Title 17A,] Chapter 1, Part
                  3, Special District Board Selection Procedures.
                      (3) (a) The board of trustees shall:
                      (i) provide for the time, place, and manner of calling its regular meetings; and


                      (ii) establish rules for its proceedings.
                      (b) [Three] Subject to the requirements of Title 52, Chapter 4, Open and Public Meetings:
                      (i) three trustees may call a special meeting by giving notice to each member [at least three
                  hours before the meeting.];
                      [(c) All] (ii) all meetings are open to the public[,]; and
                      (iii) the majority of the members of the board are a quorum for the transaction of business.
                      Section 2. Effective date.
                      This act takes effect on July 1, 1999.
