LEAVING THE SCENE OF AN ACCIDENT

             5      AN ACT RELATING TO MOTOR VEHICLES; AMENDING CERTAIN PENALTIES
             6      RELATED TO A DRIVER'S FAILURE TO STOP AND REMAIN AT THE SCENE OF AN
             7      ACCIDENT; AND MAKING TECHNICAL CORRECTIONS.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          41-6-29, as last amended by Chapters 92 and 138, Laws of Utah 1987
             11          41-6-30, as last amended by Chapter 138, Laws of Utah 1987
             12          41-6-32, as last amended by Chapter 138, Laws of Utah 1987
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Section 41-6-29 is amended to read:
             15           41-6-29. Operator's duty at accident -- Stop at accident -- Penalty.
             16          (1) (a) The operator of a vehicle involved in an accident [resulting] that results in injury
             17      to or death of any person shall immediately stop the vehicle at the scene of the accident or as close
             18      to it as possible and shall immediately return to and remain at the scene of the accident until he has
             19      fulfilled the requirements of Section 41-6-31 .
             20          (b) The stop may not obstruct traffic more than is necessary.
             21          (2) A person [failing to stop or to comply with the requirements of] who violates
             22      Subsection (1)(a) is guilty of a class A misdemeanor and shall be fined not less than $750.
             23          Section 2. Section 41-6-30 is amended to read:
             24           41-6-30. Accidents involving damage to vehicle or property -- Stop at accident --
             25      Penalty.
             26          (1) (a) The operator of a vehicle involved in an accident [resulting] that results only in
             27      damage to a vehicle or other property [which] that is operated or attended by any person, shall


             28      immediately stop the vehicle at the scene of the accident or as close to it as possible, and shall
             29      immediately return to and remain at the scene of the accident until he has fulfilled the requirements
             30      of Section 41-6-31 .
             31          (b) The stop may not obstruct traffic more than is necessary.
             32          (2) A person who violates Subsection (1)(a) is guilty of a class B misdemeanor.
             33          Section 3. Section 41-6-32 is amended to read:
             34           41-6-32. Collision with unattended vehicle or other property -- Duties of operator
             35      -- Penalty.
             36          (1) (a) The operator of a vehicle [which] that collides with or is involved in an accident
             37      with any vehicle or other property [which] that is unattended and [which] that results in damage
             38      to the other vehicle or property shall immediately stop and [either] shall:
             39          (i) locate and notify the operator or owner of the vehicle or the owner of other property of
             40      the operator's name and address and the registration number of the vehicle causing the damage[,];
             41      or [shall]
             42          (ii) attach securely in a conspicuous place on the vehicle or other property a written notice
             43      giving the operator's name and address and the registration number of the vehicle causing the
             44      damage.
             45          (b) If applicable, the operator shall also give notice under Subsections 41-6-31 (2) and (3).
             46          (2) A person who violates Subsection (1) is guilty of a class B misdemeanor.
