             6      AN ACT RELATING TO WATER DEVELOPMENT; REAUTHORIZING THE STATE
             7      WATER DEVELOPMENT COMMISSION; APPROPRIATING $28,500 FROM THE
             8      GENERAL FUND FOR FISCAL YEAR 1999-2000 TO PAY FOR COSTS OF THE
             9      COMMISSION; AND PROVIDING A SUNSET DATE.
             10      This act enacts uncodified material.
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Reauthorization of commission.
             13          (1) The State Water Development Commission created in Chapter 156, Laws of Utah
             14      1994, is reauthorized through December 31, 2003.
             15          (2) (a) The commission shall retain the same membership and staff as stated in the 1994
             16      legislation.
             17          (b) The commission shall consider and make recommendations to the Legislature and the
             18      governor on the issues specified in the 1994 legislation as well as other water issues of statewide
             19      importance.
             20          Section 2. Appropriation.
             21          Except as provided in H.B. 4, Appropriations Coordination Act, there is appropriated from
             22      the General Fund for fiscal year 1999-2000:
             23          (1) $6,000 to the Senate to pay for compensation and expenses of senators on the
             24      commission;
             25          (2) $7,500 to the House of Representatives to pay for the compensation and expenses of
             26      representatives on the commission; and
             27          (3) $15,000 to the Office of Legislative Research and General Counsel to pay for costs of


             28      staffing the commission.

This legislation raises the following constitutional or statutory concerns:

    Based on separation of powers concerns raised by the Utah Supreme Court in In re Young,
347, Utah Adv. Rep. 26, No. 970032 (July 10, 1998), it may be unconstitutional for executive
branch members to serve on a task force or commission exercising legislative powers or functions.
