CAPITOL ARTS PLACEMENT COMMISSION

5 AN ACT RELATING TO STATE COMMISSIONS AND COUNCILS; MODIFYING THE
6 MEMBERSHIP OF THE STATE CAPITOL ART PLACEMENT COMMISSION; AND
7 MAKING TECHNICAL CORRECTIONS.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 63C-9-702, as renumbered and amended by Chapter 285, Laws of Utah 1998
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 63C-9-702 is amended to read:
13 63C-9-702. State Capitol Art Placement Commission -- Created -- Membership --
14 Operations.
15 (1) (a) There is created a State Capitol Art Placement Commission composed of [nine] ten
16 members appointed as provided in this Subsection (1).
17 (b) (i) The governor shall appoint:
18 [(i)] (A) an architect, from a list of three architects submitted by the American Institute of
19 Architects;
20 [(ii)] (B) an artist, from a list of three artists submitted by the Utah Arts Council Board of
21 Directors; and
22 [(iii)] (C) an historian, from a list of three historians submitted by the Board of State
23 History.
24 (ii) The governor, as chair of the State Capitol Preservation Board created in Section
25 63C-9-201 , with the concurrence of the State Capitol Preservation Board, shall appoint a member
26 of the State Capitol Preservation Board as an ex officio, nonvoting member of the State Capitol
27 Art Placement Commission.

28 (c) (i) The president of the Senate shall appoint three members, two from the majority
29 party and one from the minority party.
30 (d) The speaker of the House shall appoint three members, two from the majority party and
31 one from the minority party.
32 (2) (a) (i) (A) [Commission] Voting commission members appointed by the governor shall
33 serve four-year terms and may serve up to two consecutive terms.
34 (B) Ex officio commission members appointed by the governor as chair of the State
35 Capitol Preservation Board shall serve two-year terms and may be reappointed.
36 (ii) Commission members appointed by the speaker and president shall serve two-year
37 terms and may be reappointed.
38 (b) In appointing members to the first commission, the governor shall designate one
39 member to serve a two-year term and two members to serve four-year terms.
40 (3) (a) Each commission member shall hold office until his successor has been appointed
41 and qualified.
42 (b) If a vacancy occurs in the commission because of death, resignation, or otherwise, the
43 appointing authority shall appoint a successor, who shall hold office for the unexpired term.
44 (c) Five voting members of the commission are a quorum for the purpose of organizing
45 and conducting the business of the commission.
46 (d) The vote of a majority of members voting when a quorum is present is necessary for
47 the commission to take action.
48 (4) (a) At the initial meeting of the commission, the commission shall select one of its
49 number to serve as chair of the commission.
50 (b) The executive director of the State Capitol Preservation Board is the nonvoting
51 secretary to the commission and shall provide staff services to the commission.
52 (5) (a) Members of the commission shall receive per diem and may be reimbursed for
53 expenses incurred in the performance of their official duties as established by the Division of
54 Finance.
55 (b) The commission shall meet at least once per year and at the call of the chair.
