EQUINE ACTIVITY LIABILITY

6 AN ACT RELATING TO THE JUDICIAL CODE; AMENDING DEFINITION TO INCLUDE
7 GOVERNMENTAL ENTITIES; AND MAKING TECHNICAL CORRECTIONS.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 78-27b-101, as enacted by Chapter 126, Laws of Utah 1992
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 78-27b-101 is amended to read:
13 78-27b-101. Definitions.
14 As used in this chapter:
15 (1) "Equine" means any member of the equidae family.
16 (2) "Equine activity" means:
17 (a) equine shows, fairs, competitions, performances, racing, sales, or parades that involve
18 any breeds of equines and any equine disciplines, including dressage, hunter and jumper horse
19 shows, grand prix jumping, multiple-day events, combined training, rodeos, driving, pulling,
20 cutting, polo, steeple chasing, hunting, endurance trail riding, and western games;
21 (b) boarding or training equines;
22 (c) teaching persons equestrian skills;
23 (d) riding, inspecting, or evaluating an equine owned by another person regardless of
24 whether the owner receives monetary or other valuable consideration;
25 (e) riding, inspecting, or evaluating an equine by a prospective purchaser; or
26 (f) other equine activities of any type including rides, trips, hunts, or informal or
27 spontaneous activities sponsored by an equine activity sponsor.

28 (3) "Equine activity sponsor" means an individual, group, governmental entity, club,
29 partnership, or corporation, whether operating for profit or as a nonprofit entity, which sponsors,
30 organizes, or provides facilities for an equine activity, including:
31 (a) pony clubs, hunt clubs, riding clubs, 4-H programs, therapeutic riding programs, and
32 public and private schools and post secondary educational institutions that sponsor equine
33 activities; and
34 (b) operators, instructors, and promoters of equine facilities, stables, clubhouses, ponyride
35 strings, fairs, and arenas.
36 (4) "Equine professional" means a person compensated for an equine activity by:
37 (a) instructing a participant;
38 (b) renting to a participant an equine to ride, drive, or be a passenger upon the equine; or
39 (c) renting equine equipment or tack to a participant.
40 (5) "Participant" means any person, whether amateur or professional, who directly engages
41 in an equine activity, regardless of whether a fee has been paid to participate.
42 (6) (a) "Person engaged in an equine activity" means a person who rides, trains, leads,
43 drives, or works with an equine.
44 (b) Subsection (6)(a) does not include a spectator at an equine activity or a participant at
45 an equine activity who does not ride, train, lead, or drive an equine.
