Mr. Speaker:
The Revenue and Taxation Committee reports a favorable recommendation on H.B. 101, INCORPORATION FEASIBILITY STUDY FOR MUNICIPALITIES, by Representative A. Tyler, with the following amendments:
1. Page 1, Line 10: At the beginning of line 10 delete "ANNEXATION" and insert "INCORPORATION"
2. Page 3, Line 72: After "(ii)" insert "in determining" and after "service" insert ",the feasibility consultant" and after "shall" delete "be the lesser of" and insert "consider"
3. Page 3, Line 74: After "incorporation;" delete "and"
4. Page 3, Line 75: After "(B)" delete the remainder of line 75 and insert:
"if the county is currently providing the service to the proposed city, the county's cost of providing the service; and
(C) if the county is not currently providing the service to the proposed city, the amount the proposed city can reasonably expect to pay for the service under a contract for the service;"
5. Page 3, Line 86: After "effective," delete "an election under" and insert "a petition under Section 10-2-109 has not yet been filed."
6. Page 3, Line 87: Delete line 87
7. Page 3, Line 89: After "Subsection (6)" insert ": (i)"
8. Page 4, Line 90: After "area" insert:
"; and
(ii) do not apply to a municipal incorporation proceeding under this part in which a petition under Section 10-2-109 has been filed"
