Mr. Speaker:

    The Political Subdivisions Committee reports a favorable recommendation on S.B. 65, IMPACT FEE ARBITRATION, by Senator L. Poulton, with the following amendments:

1.    Page 2, Line 46:    After "(8)" delete "If" and insert "(a) Except as provided in Subsection (8)(b), if"

2.    Page 2, Line 47:    After line 47 insert:
        "(b) For purposes of applying Title 63, Chapter 46b, Administrative Procedures Act, to a formal, nonbinding arbitration under this section, notwithstanding Section 63-46b-2, "agency" means a local political subdivision."
