DOMESTIC VIOLENCE DISMISSAL AMENDMENT

Senator Spencer proposes the following amendments:

1.    Page 1, Line 26:    Delete "and"

2.    Page 2, Line 28:    After line 28 insert:
        "(e) shall, in cases arising out of protective order violations, dismiss a charge involving alleged domestic violence where the alleged victim has requested, through the prosecutor, that the charge be dismissed. The prosecutor shall have only limited discretion to refuse to request a court dismissal of that charge, with that discretion being limited to determining whether the alleged victims' request was voluntary and, if that is found, the prosecutor shall request the dismissal; and"

3.    Page 2, Line 29:    Remove the brackets, reinsert "(f)" and delete "(e)"
