             6      AN ACT RELATING TO THE STATE WATER DEVELOPMENT COMMISSION;
             7      INCREASING THE NUMBER OF MEMBERS OF THE HOUSE OF REPRESENTATIVES
             8      WHO SERVE ON THE COMMISSION; AND PROVIDING A SUNSET DATE.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:

             17      This act affects uncodified material as follows:
             18      REPEALS:

             20      Be it enacted by the Legislature of the state of Utah:
             21          Section 1. Section 63-55-274 is enacted to read:
             22          63-55-274. Repeal dates -- Title 73.
             23          Title 73, Chapter 27, State Water Development Commission is repealed December 31,
             24      2003.
             25          Section 2. Section 73-27-101 is enacted to read:

CHAPTER 27. STATE WATER DEVELOPMENT COMMISSION

             27          73-27-101. River districts.


             28          For the purposes of this chapter, the river districts of the state are as follows:
             29          (1) Green River District - Daggett, Duchesne, and Uintah Counties;
             30          (2) Upper Colorado River District - Carbon, Emery, Grand, and San Juan Counties;
             31          (3) Lower Colorado River District - Beaver, h EASTERN h Garfield, Iron, Kane, h [ and ] h
             31a      Washington h , AND WAYNE h
             32      Counties;
             33           h [ (4) Sevier River District - Millard, Sanpete, Sevier, Piute, and Wayne Counties; ]
             33a          (4) LOWER SEVIER RIVER DISTRICT - MILLARD AND SANPETE COUNTIES;
             33b          (5) UPPER SEVIER RIVER DISTRICT - SEVIER, PIUTE, AND WESTERN GARFIELD
             33c      COUNTIES; h
             34           h [ (5) ] (6) h Provo River District - Juab, Utah, and Wasatch Counties;
             35           h [ (6) ] (7) h Salt Lake District - Salt Lake and Tooele Counties;
             36           h [ (7) ] (8) h Weber River District - Davis, Morgan, Summit, and Weber Counties; and
             37           h [ (8) ] (9) h Bear River District - Box Elder, Cache, and Rich Counties.
             38          Section 3. Section 73-27-102 is enacted to read:
             39          73-27-102. State Water Development Commission created.
             40          (1) The Joint Gubernatorial and Legislative State Water Development Commission is
             41      created to determine the state's role in the protection, conservation, and development of the state's
             42      water resources.
             43          (2) The commission membership shall include:
             44          (a) four members of the Senate, of whom no more than one shall represent the same river
             45      district and no more than two shall be from the same party;
             46          (b) six members of the House of Representatives, of whom no more than two shall
             47      represent the same river district and no more than four shall be from the same party;
             48          (c) a representative of the Office of the Governor;
             49          (d) a representative of the Green River District;
             50          (e) a representative of the Upper Colorado River District;
             51          (f) a representative of the Lower Colorado River District;
             52          (g) a representative of the h LOWER h Sevier River District;
             52a           h (h) A REPRESENTATIVE OF THE UPPER SEVIER RIVER DISTRICT; h
             53           h [ (h) ] (i) h a representative of the Provo River District;
             54           h [ (i) ] (j) h a representative of the Salt Lake District;
             55           h [ (j) ] (k) h a representative of the Weber River District;
             56           h [ (k) ] (l) h a representative of the Bear River District;
             57           h [ (l) ] (m) h the executive director of the Department of Natural Resources;
             58           h [ (m) ] (n) h the executive director of the Department of Environmental Quality;


             59           h [ (n) ] (o) h the commissioner of agriculture and food;
             60           h [ (o) ] (p) h a member of the Board of Water Resources;
             61           h [ (p) ] (q) h a representative of an organized environmental group; and
             62           h [ (q) ] (r) h a representative of agricultural production.
             63          (3) The president of the Senate and the speaker of the House shall appoint the commission
             64      members from the Senate and the House, respectively. The governor shall appoint the other
             65      commission members.
             66          (4) The president of the Senate and the speaker of the House shall designate one senator
             67      and one representative, respectively, as cochair.
             68          (5) Attendance of a majority of the members at a meeting constitutes a quorum for the
             69      transaction of the business of the commission.
             70          Section 4. Section 73-27-103 is enacted to read:
             71          73-27-103. Duties of commission.
             72          The commission shall consider and make recommendations to the Legislature and governor
             73      on the following issues:
             74          (1) how the water needs of the state's growing municipal and industrial sectors will be met;
             75          (2) what the impact of federal regulations and legislation will be on the ability of the state
             76      to manage and develop its compacted water rights;
             77          (3) how the state will fund water projects;
             78          (4) whether the state should become an owner and operator of water projects;
             79          (5) how the state will encourage the implementation of water conservation programs; and
             80          (6) other water issues of statewide importance.
             81          Section 5. Section 73-27-104 is enacted to read:
             82          73-27-104. Compensation and expenses of commission members.
             83          Legislators on the commission shall receive compensation and expenses as provided in
             84      Section 36-2-2 and Legislative Joint Rule 15.03. Commission members who are employees of the
             85      state shall receive no additional compensation. Other commission members shall receive no
             86      compensation or expenses for their service on the commission.
             87          Section 6. Section 73-27-105 is enacted to read:
             88          73-27-105. Staffing.
             89          The Office of Legislative Research and General Counsel shall provide the commission with


             90      the necessary staff assistance.
             91          Section 7. Repealer.
             92          This act repeals:
             93           Uncodified Chapter 8, Laws of Utah 1999, Reauthorization of State Water
             94      Development Commission.
