JOINT RESOLUTION ENCOURAGING STUDY

                 
OF ALCOHOLIC BEVERAGE SERVER TRAINING

                  A JOINT RESOLUTION OF THE LEGISLATURE URGING THE GOVERNOR'S COUNCIL
                  ON DRIVING UNDER THE INFLUENCE TO STUDY AND PREPARE CHANGES TO
                  EXISTING LAW TO STRENGTHEN TRAINING IN THE RESPONSIBLE SERVICE OF
                  ALCOHOLIC BEVERAGES FOR THOSE WORKING IN ESTABLISHMENTS LICENSED
                  TO SERVE ALCOHOLIC BEVERAGES.
                  Be it resolved by the Legislature of the state of Utah:
                      WHEREAS, the primary role of government is to protect the health, safety, and welfare of
                  citizens;
                      WHEREAS, driving under the influence of alcohol and other drugs is a major cause of
                  violence in Utah's highways;
                      WHEREAS, driving under the influence of alcohol and other drugs is a cause of preventable
                  deaths and injuries to Utah citizens;
                      WHEREAS, the cost of driving under the influence of alcohol and other drugs to Utah's
                  taxpayers and to victims is in excess of $413 million annually;
                      WHEREAS, more effective policies and programs to deal with issues related to driving
                  under the influence of alcohol and other drugs are being developed by the Governor's Council on
                  Driving Under the Influence;
                      WHEREAS, citizens are benefitting from the proactive approach of the Governor's Council
                  on Driving Under the Influence to prevent deaths, injuries, and costs associated with driving under
                  the influence of alcohol and other drugs;
                      WHEREAS, a key component of any plan to curb the violence and loss of life due to driving
                  under the influence is improved training in the responsible serving of alcoholic beverages in
                  establishments licensed to serve alcohol;
                      WHEREAS, existing laws governing training should be strengthened to require more timely


                  training of persons serving alcohol, clarify penalties for noncompliance, specify the range of training
                  subjects, provide certification requirements for those conducting the training, and require sharing of
                  records among state agencies responsible for licensing, enforcement, and training;
                      WHEREAS, through improved training and enforcement, the devastating effects of driving
                  under the influence of alcohol and other drugs can be significantly decreased; and
                      WHEREAS, changes intended to strengthen training in the responsible service of alcoholic
                  beverages will reduce the number of tragedies resulting from driving under the influence:
                      NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah urges the
                  Governor's Council on Driving Under the Influence to study ways to strengthen existing law
                  governing training in the responsible service of alcoholic beverages by persons in establishments
                  licensed to serve alcoholic beverages.
                      BE IT FURTHER RESOLVED that proposals for changes in the law be presented to the
                  Business, Labor, and Economic Development Interim Committee of the Legislature by no later than
                  its November 2000 meeting.
                      BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Governor's
                  Council on Driving Under the Influence, the Division of Substance Abuse, the Alcoholic Beverage
                  Control Commission, and the chairs of the Business, Labor, and Economic Development Interim
                  Committee of the Legislature.
