TEACHER LICENSING AMENDMENTS

             5      AN ACT RELATING TO PUBLIC EDUCATION; PROVIDING THAT A FIRST-TIME
             6      APPLICANT FOR A LEVEL 1, 2, OR 3 TEACHER'S LICENSE SHALL TAKE AND MUST
             7      PASS A BASIC SKILLS TEST AND DEMONSTRATE PROFICIENCY IN THE APPLICANT'S
             8      SPECIFIC SUBJECT AREA; PROVIDING FOR IMPLEMENTATION OF THE TESTING
             9      PROGRAM BY JANUARY 1, 2001; AND PROVIDING FOR A REPORT TO THE
             10      LEGISLATURE'S INTERIM COMMITTEE.
             11      This act affects sections of Utah Code Annotated 1953 as follows:
             12      AMENDS:
             13          53A-6-106, as repealed and reenacted by Chapter 108, Laws of Utah 1999
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 53A-6-106 is amended to read:
             16           53A-6-106. Qualifications of applicants for licenses -- Changes in qualifications.
             17          (1) The board shall establish by rule the scholarship, training, and experience required of
             18      license applicants.
             19          (2) (a) The board shall announce any increase in the requirements when made.
             20          (b) An increase in requirements shall become effective not less than one year from the date
             21      of the announcement.
             22          (3) (a) The board [may] shall determine by examination [or otherwise] the qualifications
             23      of [license] first-time applicants for a level 1, 2, or 3 license.
             24          (b) An applicant under Subsection (3)(a) shall take and must pass a basic skills
             25      examination and demonstrate subject matter proficiency in the applicant's specific subject area.
             26          (c) (i) The board shall develop or select, in collaboration with the state's colleges of
             27      education and local school boards, the instruments and procedures required to implement


             28      Subsections (3)(a) and (b) by January 1, 2001.
             29          (ii) The board shall monitor the results of the first year of the testing program under
             30      Subsections (3)(a) and (b) and report those results to the Legislature's Education Interim
             31      Committee prior to November 30, 2001, together with any recommendations for modification of
             32      the program.
             33          (4) (a) The board may determine by examination or otherwise the qualifications of
             34      applicants for renewal of a level 1, 2, or 3 license.
             35          (b) As used in Subsection (4)(a), renewal includes reinstatement of a lapsed, suspended,
             36      or revoked license.
