A JOINT RESOLUTION OF THE LEGISLATURE DIRECTING THE LEGISLATIVE
MANAGEMENT COMMITTEE TO ASSIGN TO THE APPROPRIATE INTERIM
COMMITTEE ITEMS OF STUDY; AND REQUESTING A REPORT TO THE LEGISLATURE
IN THE 2001 ANNUAL GENERAL SESSION.
Be it resolved by the Legislature of the state of Utah:
WHEREAS the Legislative Management Committee is created by law as a permanent
committee to receive and assign matters for the interim study of the Legislature; and
WHEREAS the 53rd Legislature has determined that certain legislative issues require
additional investigation and study:
NOW, THEREFORE, BE IT RESOLVED that the Legislative Management Committee
assign to the appropriate interim committee the duty to study and make recommendations for
legislative action they consider necessary to the 54th Legislature in the 2001 Annual General
Session, or earlier if indicated, from, but not limited to, the following items of study.
BE IT FURTHER RESOLVED that the Legislative Management Committee, in making
study assignments from this list and in approving study requests for individual committees, give due
regard to the available time of legislators and the budget and capacity of staff to respond adequately
to the number and complexity of the assignments given.
1. Funds Consolidation - to study and review current restricted accounts for possible
consolidation into the General Fund and the Uniform School Fund.
2. Ongoing, One-Time Appropriations - to study and review the funding of ongoing
programs with one-time monies.
3. 21st Century Library Needs Assessment - to study the condition of Utah's public library
facilities, library governance and funding structures, and public support for public libraries.
4. Apprenticeship and Education Licensing Requirements - to study contractor licensing,
apprenticeship, and education requirements for various trades.
5. Arbitration for Personal Injury - to study laws governing binding arbitration for small
personal injury claims.
6. Attorney Lien Law - to study whether current lien law is adequate for attorneys to ensure
that they are compensated for services rendered. (1st Sub. H.B. 150)
7. Business Incentives - to study the incentives to business and industrial recruitment offered
in Utah compared with other states to determine whether to reduce, expand, or maintain current
recruitment efforts.
8. Cash Loan Practices - to study the interest rate and fee practices of the cash loan/check
loan industry.
9. Consumer Credit - to study issues related to the accuracy of consumer credit information.

10. Consumer Information and Dispute Resolution - to study whether to require reporting
agencies to disclose certain information to consumers, and to develop a dispute resolution process.
11. Continuing Education in Insurance Industry - to study whether all insurance salesmen
and adjusters should be required to take continuing education courses.
12. Corporations and Commercial Code Provisions - to study the consistency of provisions
related to business entities and the activities of the Division of Corporations and Commercial Code.
13. Development of Closed Bases - to study the development of military bases closed
resulting from the federal base closure process.
14. Development of Tooele Army Depot - to study the infrastructure support for the
economic development of Tooele Army Depot.
15. Disability Insurance Coverage - to study changes to insurance laws including disability
insurance coverage requirements. (S.B. 190)
16. Discrimination Against OSHA Whistleblowers - to study discrimination against persons
who complain of Occupational Safety and Health Act violations.
17. Displaying Auto Sales Fees - to study whether all fees, such as the documentary service
fee, should be disclosed as part of an automobile's sticker price.
18. Drive-Through Liquor Sales - to study whether beer and related products should be sold
by a business with a drive-through service.
19. Engineer Licensing - to study changes to civil, electrical, and mechanical engineer
licensing.
20. Housing Trust Fund - to study options and equity issues for permanently funding the
Olene Walker Housing Trust Fund to the full trust level.
21. Indirect Purchasers - to study changes to laws governing indirect purchasers.
22. Individual Development Accounts - to study how to fund individual development
accounts as a tool to help low income Utahns, fund education, and other allowable activities.
23. Industrial Manual Replacement - to study whether to replace the 1987 Standard
Industrial Classification Manual with the 1997 North American Industry Classification System.
24. Insurance Notification in Divorce - to study issues related to insurance notification in
divorce situations. (H.B. 73)
25. Lien Laws - to study changes to current lien laws.
26. Mobile Home Conflicts - to study how to resolve various conflicts between renters and
park owners.
27. Movie Theater Age Verification - to study whether to require that movie theaters require
verification of the age of patrons for admittance to age-restricted movies. (H.B. 316)
28. Multilevel Marketing - to study whether there should be mandatory disclosure language
to protect consumers from pyramid schemes.
29. Privacy of Personal Information - to study how and for what purposes personal
information regarding consumers is collected and transferred, including a review of federal legislation
and the laws of other states. (1st Sub. H.B. 70)
30. Property Owner Equity Foreclosure - to study issues related to loss or repayment of
property owner's equity in a foreclosure action.
31. Residential Lien Recovery Fund - to study issues related to the Residential Lien
Recovery Fund. (S.B. 193)
32. Revised Nonprofit Corporations Act - to study the implementation of the Revised
Nonprofit Corporations Act. (1st Sub. S.B. 61)
33. Scope of Unprofessional Conduct Laws - to study whether to require individuals
engaged in an internship, residency, preceptorship, postceptorship, fellowship, apprenticeship, or
on-the-job-training program approved by the Division of Occupational and Professional Licensing
to be bound by the laws governing unlawful and unprofessional conduct.
34. Subcontractors Insurance - to study the extension of insurance coverage to include
subcontractors.
35. Task Force on Lien Recovery - to study the development of a task force to examine a
lien recovery fund.
36. Tax on Alcoholic Beverages - to study whether to increase the sales tax on alcoholic
beverages.
37. Utah Professional Boxing Regulation - to study the rewriting of Title 58, Chapter 66,
Utah Professional Boxing Regulation Act, and to move the Utah Boxing Commission out of the
Division of Occupational and Professional Licensing and grant it regulatory power and the means to
promote the sport.
38. Alternative Schools - to study the additional needs and benefits of alternative schools
to both public schools and students.
39. Best Practices in School Change - to study the variety of resources, programs, strategies,
and innovative ideas that are currently used throughout the country to support and manage school
change.
40. Capital Foundation and School Building Aid - to study if the existing capital foundation
and emergency school building aid formula is equitable.
41. Career Ladder Money - to study the use of career ladder money.
42. Class Size Reduction - to study whether to require local school boards to limit or reduce
the size of core subject classes in high school and reduction of elective classes. (H.B. 238)
43. Classroom Communication Amplification - to study the amplification requirements for
classes with hearing impaired students and the creation of a three-year pilot program.
44. Computer Assisted Learning - to study and identify electronic programs and computer
assisted learning systems which will help learning disabled, remedial, and low achieving students with
core subjects that could be implemented within all school districts.
45. Content of Course Standards - to study the creation of course standards for classwork
in each grade and determine the level of performance considered proficient.
46. Cost of School-related Clothing - to study the high cost of clothing related to a specific
school.
47. Early Childhood and School Success - to study the effect of early childhood environment
on school success.
48. Engineering and Computer Science Students - to study solutions to the shortage of
engineering and computer science college students to fill existing and future jobs in Utah's information
technology sectors.
49. English-As-Second-Language Endorsement Requirements - to study how school districts
are complying with requirements that teachers working with English-as-a-second-language children
have an endorsement from the state.
50. Extending Learning Time - to study whether to extend learning time through tutorial or
summer school programs and extending school hours for students who have been unable to reach
competency.
51. Full Day Kindergarten - to study whether to require full day kindergarten. (S.B. 99)
52. Higher Education Funding - to study the funding of higher education based on growth.
53. Higher Education Necessarily Existent Small Schools - to study how to apply the
necessarily existent small schools concept to small higher education institutions.
54. Higher Education Start-up Costs - to study and review new start-up programs by
colleges and universities.
55. Improving Teacher Quality - to study ways to improve teacher quality by examining
performance-based licensing, teacher mentoring and professional development, peer assistance and
review, and teacher training in technology.
56. Institutional Roles in Blanding and San Juan - to study whether Blanding and the San
Juan Center should receive services and oversight by Utah State University, the College of Eastern
Utah, or both.
57. Intercept Program Costs - to study the costs of the Intercept Program to help learning
disabled students.
58. Interventions to Improve School Performance - to study interventions such as tutoring
and technology to improve school performance.
59. Kindergarten Preassessment - to study issues related to current kindergarten
preassessment, how it differs from what was done prior to the law requiring preassessment, and
whether it should be changed.
60. Personnel Policies in Higher Education - to study the consolidation of personnel policies
for classified employees in the higher education system.
61. Policies Regarding Returning Teachers - to study actions of the State Board of
Education which may limit qualified teachers from reentering the job market when returning
from family related activities.
62. Quality Teaching - to study how to attract and retain the highest quality teachers in the
classroom including recruitment, preservice training at universities, licensing, and professional
development of existing teachers.
63. Saving Accounts for Teachers - to study the establishment of medical savings accounts
for teachers.
64. School District and School Size - to study optimal school and district sizes and
configurations.
65. School Reform - to study comprehensive school reform rather than piecing together a
series of often isolated and disconnected efforts, including focus on professional development,
curriculum, governance, and school management.
66. School Starting Time - to study whether school should start later in the day.
67. Sex Education - to study the education of children regarding the consequences of sexual
activity, including who should provide the instruction, how it should be conducted, and where.
68. Shared Governance Model - to study legislation encouraging school districts to adopt
a shared governance model or to encourage the adoption of models that school districts can use to
encourage greater participation from patrons.
69. Student on School Board - to study legislation that allows school districts to have a
student as a member of the school board.
70. Teaching Load - to study ways to balance teaching loads of core curriculum teachers
with the instructional load typically carried by elective class instructors.
71. Textbook Costs - to study the high costs of textbooks in public and higher education.
72. Textbook Purchases - to study whether to give parents the opportunity or choice of
purchasing their child's textbooks.
73. Boards and Commissions - to study and review commissions and boards including
responsibilities and duties, fiscal impact, membership, and whether they should be continued.
74. Bonding Conflicts of Interest - to study the potential conflicts of interest if a state bond
advisor is also employed by a bond company and can bid on state projects.
75. Challenged Ballots - to study whether to modify procedures for addressing challenged

76. Debt Collection Powers - to study the enhancement of the powers of the Office of State
Debt Collection to collect debts and fees.
77. Money Management Act Revisions - to study the role of the Utah Money Management
Council and the need for amendments to the Utah Money Management Act to facilitate the use of
electronic investment activities and facilitate the implementation of a state-wide computer network
program through the state treasurer's office.
78. Multiple Choices on Ballots - to study the use of multiple choices on ballots to determine
an election by a majority.
79. Procurement Code and Health Care Benefits - to study procurement code requirements
of health care benefits. (S.B. 7)
80. State 911 Service - to study creating a state 911 office/agency; whether to require local
governments to share 911 revenues with the state to fund the office; and the current fee to determine
whether or not it is adequate.
81. Voter Information Pamphlet - to study the transfer of responsibility for the Voter
Information Pamphlet impartial analysis on initiatives or referenda from the Office of Legislative
Research and General Counsel to the Office of the Lieutenant Governor or the Office of the Attorney
General.
82. Breast Implant Surgery - to study whether to institute informed consent requirements
prior to breast implant surgery. (H.B. 229 and 1st Sub. H.B. 229)
83. Disease Testing - to study disease testing for emergency medical service providers and
volunteers.
84. Division of Services for People with Disabilities - to study and review the services
provided by the Division of Services for People with Disabilities, including contracts with service
providers, utilization of additional funding provided to the division and its service providers for the
previous five years; the number of clients served and types of services provided; costs of services
provided; and costs of administration and service coordination.

89. Local Health Department Fees - to study the authority of local health departments to
assess fees. (S.B. 217)
90. Medical Directives - to study issues related to advanced medical directives. (S.B. 54)
91. Oversight of Psychiatric Prescriptions - to study the prescribing of psychiatric drugs for
medication of children. (H.B. 380)
92. Parental Consent for Medication - to study ways to ensure that a parent is granted
informed consent when a child is prescribed psychiatric medications.
93. Portability of Mental Health Services - to study portability between home and
community-based services and services in an intermediate care facility for the mentally disabled.

devices that have integrated safety in health care facilities.

101. Coparenting in Divorce - to study the development of coparenting plans for divorcing

104. Lawsuits by the State - to study the amending of Section 78-12-2, which currently
provides a statute of limitations within which the state must initiate an action involving real estate,
and create an exception for lawsuits involving sovereign lands.
105. Murder as a Capital Offense - to study whether murder committed at any degree should
be tried as a capital offense.
106. Peremptory Challenge of a Judge - to study a pilot program in the 2nd, 3rd, and 4th
judicial districts to allow for the peremptory challenge of a judge in all cases.
107. Repeal of Law Due to Constitutional Change - to study whether Title 78, Chapter 51
of the Utah Code, governing attorneys and counselors, should be partially or completely repealed in
light of the rewrite of the Judicial Article of the Utah Constitution.
108. Small Claims Court Jurisdiction - to study whether to limit awards in small claims

subdivision with multiple jurisdictions.

whether an interlocal agreement is to be entered into between the White City Water Improvement
District and the Metropolitan Water District of Salt Lake City.
142. Jurisdiction of Cities and Towns - to study the jurisdiction of cities and towns as it
relates to the siting of school buildings.
143. Special District Board Elections - to study the election of special district board
members in districts that may impose a property tax.
144. Special District Uniformity - to study special district uniformity, dissolution,
withdrawal, and other issues related to special districts.
145. Toll Free Government Numbers - to study increased access to state government by
publishing state government toll free 800 numbers to rural Utah.
146. Electronic Mail Regulations - to study the prohibiting of certain electronic mail
solicitation practices.
147. Public Utilities - to study the regulation of public utilities.
148. Public Utility Law - to study various changes to current public utility laws. (H.B. 320)
149. Public Utility Lines - to study whether to amend the definition of underground facility
to include a sewer lateral.
150. Public Utility Regulatory Structure Task Force - to study how to most effectively
organize the task force. (1st Sub. H.B. 320)
151. Telecommunications Competition and Taxation - to study redefining
telecommunications competition in light of wireless phone service and cable tv phone service and
review the taxation of telecommunication services.
152. Telecommunications Industry - to study the telecommunications industry and the level
of competition.
153. Telecommunications Law Changes - to study changes to laws governing pricing
flexibility for incumbent telephone corporations and the price index for tariffed public

construction including the shortfall in the Centennial Highway Fund, funding options, bonding, and

legislators, including what is done in other states, and whether the process should be changed.

number for community service referrals.
