Mr. President:

    The State and Local Affairs Committee reports a favorable recommendation on S.B. 78, UTILITIES IN HIGHWAY RIGHTS-OF-WAY, by Senator L. Blackham, with the following amendments:
1.    Page 8, Line 218:    After "(d)" insert "(i)" and after "provide for the" insert "proportionate"

2.    Page 8, Line 219:    Delete "." and insert "based on the amount of conduit innerduct space that is authorized in the agreement for the trench.

        (ii) If two or more telecommunications facility providers are required to share a single trench, each telecommunications facility provider in the trench shall share the cost and benefits of the trench in accordance with Subsection (3)(d)(i) on a fair, reasonable, competitively neutral, and nondiscriminatory basis."
