Second Substitute H.B. 189

Senator John W. Hickman proposes to substitute the following bill:

FEDERAL GOVERNMENT ACQUISITION OF

             2     
REAL PROPERTY IN THE STATE

             3     
2001 GENERAL SESSION

             4     
STATE OF UTAH

             6      This act enacts provisions that prohibit the federal government from acquiring land in the
             7      state from any state agency without the approval of the Legislature. The act expands the
             8      duties of the Constitutional Defense Council. The act creates a policy for the use or
             9      disposition of public lands within the state.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      ENACTS:
             12          63-34b-101, Utah Code Annotated 1953
             13          63C-4-105, Utah Code Annotated 1953
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 63-34b-101 is enacted to read:
             16          63-34b-101. Federal government acquisition of real property in the state.
             17          (1) As used in this section:
             18          (a) "Agency" is defined in Section 63-38b-101 .
             19          (b) "Agency" includes S : (i) s the School and Institutional Trust Lands Administration
             19a      created in
             20      Section 53C-1-201 S [.] ; AND (ii) THE SCHOOL AND INSTITUTIONAL TRUST LANDS BOARD OF
             20a      TRUSTEES CREATED IN SECTION 53C-1-202 . s .
             21          (2) (a) Before legally binding the state by executing an agreement to sell or transfer to the
             22      United States government 10,000 or more acres of any state lands S OR SCHOOL AND
             22a      INSTITUTIONAL TRUST LANDS s , an agency shall submit the
             23      agreement or proposal:
             24          (i) to the Legislature for its approval or rejection; or
             25          (ii) in the interim, to the Legislative Management Committee for review of the agreement


             26      or proposal.
             27          (b) The Legislative Management Committee may:
             28          (i) recommend that the agency execute the agreement or proposal;
             29          (ii) recommend that the agency reject the agreement or proposal; or
             30          (iii) recommend to the governor that he call a special session of the Legislature to review
             31      and approve or reject the agreement or proposal.
             32          (3) Before legally binding the state by executing an agreement to sell or transfer to the
             33      United States government less than 10,000 acres of any state lands S OR SCHOOL AND
             33a      INSTITUTIONAL TRUST LANDS s , an agency shall report to the
             34      Natural Resources, Agriculture, and Environment Interim Committee.
             35          (4) Notwithstanding Subsections (2) and (3), the Legislature approves all conveyances of
             36      school trust lands to the United States government made for the purpose of completing the Red
             37      Cliffs Desert Reserve in Washington County.
             38          Section 2. Section 63C-4-105 is enacted to read:
             39          63C-4-105. Policy for public lands within the state.
             40          (1) It is the policy of the state to claim and preserve by lawful means the rights of the state
             41      and its citizens to determine and affect the disposition and use of federal lands within the state as
             42      those rights are granted by the United States Constitution, the Utah Enabling Act, and other
             43      applicable law.
             44          (2) The Constitutional Defense Council shall study, formulate, and recommend appropriate
             45      legal strategies and arguments to further this policy.
