NAME OF SPECIAL DISTRICT AMENDMENTS

             5      This act modifies provisions relating to Special Districts to authorize a special district board
             6      to change the name of the special district and to require notice of the name change to be
             7      given.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          17A-1-204, as enacted by Chapter 185, Laws of Utah 2000
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 17A-1-204 is amended to read:
             13           17A-1-204. Name of special district.
             14          (1) The name of each special district created on or after May 1, 2000 shall comply with
             15      Subsection 17-50-103 (2)(a).
             16          (2) The board of each special district affected by Subsection 17-50-103 (2)(b) shall ensure
             17      that after January 1, 2005 the special district name complies with the requirements of that
             18      subsection.
             19          (3) (a) A special district board may change the name of that special district by:
             20          (i) holding a public hearing on the proposed name change;
             21          (ii) adopting a resolution approving the name change; and
             22          (iii) giving written notice of the name change to the lieutenant governor, the State Tax
             23      Commission, the state auditor, and the clerk, recorder, and assessor of each county in which any
             24      part of the special district is located.
             25          (b) A name change under Subsection (3)(a) becomes effective upon the board's giving the
             26      notice required under Subsection (3)(a)(iii).
