FISHING LICENSE EXEMPTION FOR YOUTH

             6      This act modifies the Wildlife Code to allow certain youth in custody of the Division of Youth
             7      Corrections to fish without a license.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          23-19-14, as last amended by Chapter 128, Laws of Utah 1999
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 23-19-14 is amended to read:
             13           23-19-14. Persons residing in certain institutions authorized to fish without license.
             14          (1) The Division of Wildlife Resources shall permit a person to fish without a license if:
             15          (a) (i) the person resides in:
             16          [(i)] (A) the Utah State Developmental Center in American Fork;
             17          [(ii)] (B) the state hospital;
             18          [(iii)] (C) a veteran's hospital;
             19          [(iv)] (D) a veteran's nursing home;
             20          [(v)] (E) a mental health center;
             21          [(vi)] (F) an intermediate care facility for the mentally retarded;
             22          [(vii)] (G) a group home licensed by the Department of Human Services and operated
             23      under contract with the Division of Services for People with Disabilities; [or]
             24          (H) a group home or other community-based placement licensed by the Department of
             25      Human Services and operated under contract with the Division of Youth Corrections; or
             26          [(viii)] (I) another similar institution approved by the division; or
             27          (ii) the person is a youth who participates in a work camp operated by the Division of


             28      Youth Corrections;
             29          (b) the person is properly supervised by a representative of the institution; and
             30          (c) the institution obtains from the division a certificate of registration that specifies:
             31          (i) the date and place where the person will fish; and
             32          (ii) the name of the institution's representative who will supervise the person fishing.
             33          (2) The institution must apply for the certificate of registration at least ten days before the
             34      fishing outing.
