             9      This resolution modifies joint legislative rules by renaming appropriation subcommittees to
             10      accurately reflect their jurisdiction. This resolution takes effect upon passage by both the
             11      House and Senate.
             12      This resolution affects legislative rules as follows:
             13      AMENDS:
             14          JR-3.02
             15          JR-3.06
             16      Be it resolved by the Legislature of the state of Utah:
             17          Section 1. JR-3.02 is amended to read:
             18           JR-3.02. Joint Appropriations Committee.
             19          (1) The Joint Appropriations Committee of the Legislature consists of all the members of
             20      the Legislature.
             21          (2) (a) The members of the Joint Appropriations Committee shall be divided into the
             22      following subcommittees:
             23          (i) Capital Facilities and Administrative Services;
             24          (ii) Commerce and Revenue;
             25          (iii) Economic Development and Human Resources;
             26          (iv) Executive Offices[,] and Criminal Justice[, and Legislature];
             27          (v) Health and Human Services;


             28          (vi) Higher Education;
             29          (vii) [Physical] Natural Resources;
             30          (viii) Public Education;
             31          (ix) Quasi-Governmental Entities; and
             32          (x) Transportation and Environmental Quality.
             33          (b) The President of the Senate and Speaker of the House shall appoint their respective
             34      members to each subcommittee.
             35          (c) The Quasi-Governmental Entities Subcommittee shall have the same members as the
             36      Legislative Quasi-Governmental Entities Committee created in Section 63-95-201 .
             37          (3) (a) A majority of any committee or subcommittee constitutes a quorum for the
             38      transaction of business.
             39          (b) In determining a committee or subcommittee quorum, a majority is at least 50% in one
             40      house and more than 50% in the other.
             41          (c) In all decisions of the subcommittees, a majority vote will prevail. A majority vote is
             42      at least 50% of the members of one house and more than 50% in the other house in attendance.
             43          (4) (a) There shall be an Executive Appropriations Committee consisting of 18 members
             44      composed of:
             45          (i) three members of the majority leadership of the Senate and four members of the
             46      majority leadership of the House;
             47          (ii) two members of the minority leadership of the Senate and three members of the
             48      minority leadership of the House;
             49          (iii) the chair of the Senate Appropriations Committee and the chair of the House
             50      Appropriations Committee; and
             51          (iv) (A) one member from the majority party of the Senate as appointed by the President
             52      of the Senate or as chosen by the Senate majority caucus;
             53          (B) two members from the minority party of the Senate as appointed by the Senate
             54      minority leader or as chosen by the Senate minority caucus; and
             55          (C) one member from the minority party of the House as appointed by the House minority
             56      leader or as chosen by the House minority caucus.
             57          (b) A member of the Executive Appropriations Committee, whose membership is
             58      determined under Subsection (4)(i) or (ii), may appoint a designee to permanently serve in that


             59      individual's place with the approval of the Speaker or the President for any majority party member
             60      or with the approval of the House or Senate minority party leader for any minority party member.
             61          (c) In all decisions of the Executive Appropriations Committee, a majority vote prevails.
             62      When a division is requested, that vote must include at least 50% of the members of one house and
             63      more than 50% of the members of the other house in attendance.
             64          (5) (a) The Executive Appropriations Committee shall meet no later than the third
             65      Wednesday in December to:
             66          (i) direct staff as to what revenue estimate to use in preparing budget recommendations;
             67          (ii) decide whether or not to set aside special allocations for the end of the session;
             68          (iii) set aside an appropriate amount for fiscal note bills;
             69          (iv) approve the appropriate amount for each subcommittee to use in preparing its budget;
             70      and
             71          (v) set a budget figure.
             72          (b) The chairs of each appropriation subcommittee are invited to attend this meeting.
             73          (6) The Office of Legislative Fiscal Analyst shall prepare revised revenue estimates in
             74      February.
             75          (7) The Executive Appropriations Committee shall include in its consideration tax
             76      collections and revenue policy, tax administration, and analysis of revenue sources.
             77          (8) (a) With the approval of the Executive Appropriations Committee, time schedules for
             78      subcommittee meetings will be determined so that no conflict exists with the annual general
             79      sessions or standing committee meetings of the Legislature.
             80          (b) Appropriations subcommittees may not meet while the Senate or House is in session
             81      without special leave from the Speaker of the House and the President of the Senate.
             82          (9) (a) (i) It is the duty of the appropriations chair of each house to receive the reports of
             83      the subcommittees and to forward the reports to the Executive Appropriations Committee.
             84          (ii) The Executive Appropriations Committee shall combine the reports into a total
             85      appropriations bill.
             86          (b) The Executive Appropriations Committee shall establish a liaison between their
             87      committee and each of the appropriations subcommittees.
             88          (10) All proposed items of expenditure to be included in the final appropriations bill,
             89      including appropriations for the Legislature and its committees and staff, shall be submitted to one


             90      of the subcommittees named in this rule for consideration and recommendation.
             91          (11) (a) After receiving and reviewing subcommittee reports, the Executive Appropriations
             92      Committee may refer the report back to an appropriations subcommittee with any guidelines the
             93      Executive Appropriations Committee considers necessary to assist the subcommittee in producing
             94      a balanced budget.
             95          (b) The subcommittee shall meet to review the new guidelines and report the adjustments
             96      to the chairs of the Executive Appropriations Committee as soon as possible.
             97          (12) (a) After receiving the reports, the appropriations chairs will report them to the
             98      Executive Appropriations Committee.
             99          (b) That committee shall:
             100          (i) make any further adjustments necessary to balance the budget; and
             101          (ii) complete all decisions necessary to draft the final appropriations bill no later than the
             102      38th day of the annual general session.
             103          (13) (a) During the interim, the Executive Appropriations Committee shall meet at least
             104      every other month on the day before interim meetings on alternating months between Legislative
             105      Management Committee meetings.
             106          (b) The first meeting of the Executive Appropriations Committee shall be in the month
             107      following the first meeting of the Legislative Management Committee.
             108          (c) The appropriations subcommittee chairs may attend these meetings and provide input
             109      regarding their budget.
             110          Section 2. JR-3.06 is amended to read:
             111           JR-3.06. Recommendation on Appropriation for Collaborative Programs.
             112          (1) Eighteen members of the Legislature, appointed under Subsection (2), shall meet
             113      during the general session to review the recommendation of the Legislative Fiscal Analyst and
             114      governor's budget recommendation on collaborative programs for children and youth at risk and
             115      make an annual recommendation to the subcommittees in Subsection (2) and the Executive
             116      Appropriations Committee on the amount to be appropriated for these programs.
             117          (2) (a) The President of the Senate shall appoint a Senator from the majority party, a
             118      Senator from the minority party, and the Senate chair from each of the following appropriation
             119      subcommittees:
             120          (i) Executive Offices[,] and Criminal Justice[, and Legislature];


             121          (ii) Health and Human Services; and
             122          (iii) Public Education.
             123          (b) The Speaker of the House of Representatives shall appoint a Representative from the
             124      majority party, a Representative from the minority party, and the House chair from each of the
             125      following appropriation subcommittees:
             126          (i) Executive Offices[,] and Criminal Justice[, and Legislature];
             127          (ii) Health and Human Services; and
             128          (iii) Public Education.
             129          (3) From among the chairs appointed under Subsection (2), the President of the Senate
             130      shall appoint a Senate chair and the Speaker of the House shall appoint a House chair to conduct
             131      the meetings of this group.
             132          (4) This group shall meet as necessary during the general session to develop their
             133      recommendation to the Executive Appropriation Committee during the legislative session and shall
             134      be governed by the rules of this chapter.
             135          Section 3. Effective date.
             136          This resolution takes effect upon approval by a constitutional majority vote of all members
             137      of the Senate and House of Representatives.
