Chair Saunders called the meeting to order at 8:11 a.m.
MOTION: Representative Jones moved to approve the minutes of the January 16, 2002
committee meeting. The motion passed unanimously with Representative Donnelson
and Representative Thompson absent for the vote.
At the request of the sponsor, H.B. 112 Health Care Malpractice Act Amendments (K. Garn)
was not considered in this meeting.
1st Sub H.B. 231 Public Health Authority Amendments (S. Allen)
Representative Allen presented the bill and proposed a 2nd substitute to the bill.
MOTION: Representative Arent moved that 2nd Substitute H.B. 231 replace 1st Substitute H.B.
231. The motion passed unanimously with Representative Donnelson,
Representative Thompson, and Representative Way absent for the vote.
Representative Allen explained the substitute bill to the committee with the assistance of Mr.
Douglas Springmeyer, Utah Department of Health.
MOTION: Representative Beck moved to amend the bill as follows:
Page 4, Line 106: After "director" insert "or in the absence of the executive
director, his designee
The motion passed with Representative Donnelson voting no. Representative
Thompson was absent for the vote.
Mr. Chet Loftis, General Counsel - Utah Medical Association, spoke in support of the bill.
Mr. James V. Olsen, Utah Merchants Association, expressed concerns with the bill.
MOTION: Representative Way moved to pass 2nd Substitute H.B. 231 out favorably as
amended. The motion passed with unanimously with Representative Thompson
absent for the vote.
H.B. 12 Use of Tobacco Settlement Interest Proceeds (K. Morgan)
Representative Morgan explained the bill to the committee.
MOTION: Representative Lockhart moved to pass the bill out favorably. The motion passed
unanimously with Representative Thompson absent for the vote.
MOTION: With the approval of the sponsor, Representative Way moved to place the bill on the
Consent Calendar. The motion passed unanimously with Representative Thompson
absent for the vote.
H.B. 105 Health Insurance Mandates - Pilot Program (R. Lockhart)
Representative Lockhart explained the bill to the committee.
Speaking in support of the bill were Mr. John T. Nielsen, Intermountain Health Care, Ms.
Jennifer Cannaday, Regence Blue Cross and Blue Shield of Utah, Mr. Rick Martin , Utah
Association of Health Underwriters, and Ms. Suzette Green-Wright, Insurance Department.
Ms. Catherine J. Dupont, Associate General Counsel, Office of Legislative Research and General
Counsel, answered questions of committee members.
MOTION: Representative Way moved to pass the bill out favorably. The motion passed with
Representative Arent, Representative Beck, Representative Jones, and
Representative Litvak voting no. Representative Thompson was absent for the vote.
H.B. 243 Child Immunization Amendments (R. Lockhart)
Representative Lockhart explained the bill to the committee.
Mr. Douglas Springmeyer, Department of Health, answered questions of committee members.
Ms.Gayle Ruzicka, Utah Eagle Forum, spoke in support of the bill.
Ms. Darline P. Robles, Superintendent - Salt Lake City School District, and Mr. Darrell White,
Superintendent - Davis School District, spoke in opposition to the bill.
MOTION: Representative Mascaro moved to pass the bill out favorably. The motion passed
with Representative Arent, Representative Jones, Representative Litvack, and
Representative Ray voting no.
H.J.R. 10 Resolution Urging Federal Constitutional Amendment to Protect the Life of the
Unborn (G. Way)
Representative Way explained the bill to the committee.
MOTION: Representative Lockhart moved that the bill be placed as the first item on the agenda
of the next committee meeting. The motion passed with Representative Thompson
voting no.
MOTION: Representative Way moved to adjourn the meeting. The motion passed
unanimously.
Chair Saunders adjourned the meeting at 9:54 a.m.
