General Description:

This bill modifies provisions of the Concealed Weapons Act by creating a dedicated

credit as a revenue stream to cover the costs incurred by the Criminal Investigations and
11
Technical Services Division of the Department of Public Safety in issuing concealed
12

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53-5-707
is amended to read:

53-5-707. Permit -- Fees -- Disposition.
31
(1) (a) Each applicant for a permit shall pay a fee of $35 at the time of filing an
32
application.

(b) The initial fee shall be waived for an applicant who is a law enforcement officer
34
under Section
53-13-103
.

(2) The renewal fee for the permit is $10.
36
(3) The replacement fee for the permit is $10.
37
(4) The late fee for the renewal permit is $7.50.

[(5) All fees shall promptly be deposited in the state treasury and credited to the

General Fund.]

excess of the amount necessary to cover the cost of issuing concealed firearm permits under

this part shall be retained by the Bureau of Criminal Identification to help fund any other

costs incurred by the bureau, but only for the fiscal year 2007-08. .S

(6) (a) The division may collect any fees charged by an outside agency for additional
43
services required by statute as a prerequisite for issuance of a permit.

(b) The division shall promptly forward any fees collected under Subsection (6)(a) to
45
the appropriate agency.

(7) The division shall make an annual report to the Legislature's Law Enforcement and
47
Criminal Justice Interim Committee on the amount and use of the fees collected under this
48
section.

(1) As an ongoing appropriation subject to future budget constraints, there is

appropriated from the General Fund for the fiscal year 2007-08, a negative $653,900 and from

dedicated credits for the fiscal year 2007-08, a positive $653,900 to the Bureau of Criminal

Identification within the Criminal Investigations and Technical Services Division of the
48f
Department of Public Safety to cover the cost of the bureau's issuing concealed firearm
48g
permits.

(2) The appropriations in Subsection (1) are in addition to amounts previously
48i
appropriated to the bureau for the fiscal year 2007-08.
