Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53A-3-202
is amended to read:

53A-3-202. Compensation for services -- Additional per diem -- Insurance --
30
Approval of expenses.
31
(1) [(a)] Each member of a local school board, except the student member, shall
32
receive [an amount not to exceed $3,000 per year, payable monthly, as] compensation for
33
services[.] and for necessary expenses in accordance with board compensation schedules
34
adopted by the local school board in accordance with the provisions of this section.
35
[(b) Members shall also receive compensation for necessary expenses on the same
36
basis as members of the State Board of Education.]
37
[(c) The board shall determine the exact amount under this statutory guideline.]

[(2) Each member may receive, as approved by the board, additional per diem
39
compensation equal to that established for state board members under Section
53A-1-202
for
40
attendance at meetings and activities related to any business of the local school board, not to
41
exceed 12 per year.]

[(3) Board members may participate in any group insurance plan provided to
43
employees of the school district as part of their compensation on the same basis as required for
44
employee participation.]

(2) H. [
If
] Beginning on July 1, 2007, if .H a local school board decides to adopt or
45a
amend its board compensation schedules,
46
the board shall set a time and place for a public hearing at which all interested persons shall be
47
given an opportunity to be heard.
48
(3) Notice of the time, place, and purpose of the meeting shall be provided at least
49
seven days prior to the meeting by:
50
(a) publication at least once in a newspaper published in the county where the school
51
district is situated and generally circulated within the school district; and
52
(b) posting a notice:
53
(i) at each school within the school district;
54
(ii) in at least three other public places within the school district; and
55
(iii) on the Internet in a manner that is easily accessible to citizens that use the Internet.

(4) After the conclusion of the public hearing, the local school board may adopt or
57
amend its board compensation schedules.

[(4)] (5) Each member shall submit an itemized account of necessary travel expenses
59
for board approval.

H. (6) A local school board may, without following the procedures described in

Subsections (2) and (3), continue to use the compensation schedule that was in effect prior to

July 1, 2007 until, at the discretion of the board, the compensation schedule is amended or a

new compensation schedule is adopted. .H
