7 LONG TITLE
8 General Description:
9 This bill modifies the Division of Fleet Operations and Administration of State Motor
10 Vehicles chapter to amend the definition of motor vehicle for purposes of state fleet
11 regulations.
12 Highlighted Provisions:
13 This bill:
14 . amends the definition of motor vehicles to exclude vessels, aircraft, or vehicles used
15 as light equipment including golf carts, motorized maintenance mules, and riding
16 lawn mowers; and
17 . makes technical changes.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 63A-9-101 is amended to read:

28 63A-9-101. Definitions.
29 (1) (a) "Agency" means each department, commission, board, council, agency,
30 institution, officer, corporation, fund, division, office, committee, authority, laboratory, library,
31 unit, bureau, panel, or other administrative unit of the state.
32 (b) "Agency" includes the State Board of Education, the Office of Education, each
33 Applied Technology Center, the board of regents, the institutional councils of each higher
34 education institution, and each higher education institution.
35 (c) "Agency" includes the legislative and judicial branches.
36 (2) "Committee" means the Motor Vehicle Review Committee created by this chapter.
37 (3) "Director" means the director of the division.
38 (4) "Division" means the Division of Fleet Operations created by this chapter.
39 (5) "Executive director" means the executive director of the Department of
40 Administrative Services.
41 (6) (a) "Motor vehicle" means:
42 (i) a self-propelled vehicle [capable of carrying passengers.] H. designed or .H intended
42a primarily for use
43 and operation on the highways; or
44 [(b) "Motor vehicle" includes vehicles]
45 (ii) a vehicle used for construction and other nontransportation purposes.
46 (b) "Motor vehicle" does not include:
47 (i) a vessel as defined under Section 73-18-2 ;
48 (ii) an aircraft as defined under Section 72-10-102 ; or
49 (iii) a vehicle used as light equipment including a golf cart, motorized maintenance
50 mule, or riding lawn mower.
51 (7) "State vehicle" means each motor vehicle owned, operated, or in the possession of
52 an agency.
