LONG TITLE

General Description:

This bill appropriates certain ongoing General Fund monies to the Office of the
13
Attorney General to fund certain programs related to fighting child pornography crimes.

Highlighted Provisions:

This bill:
16
. appropriates monies to the Office of the Attorney General for the following items
17
related to Title 76, Chapter 5a, Sexual Exploitation of Children:
18
. replacement of federal funding cuts to the ICAC (Internet Crimes Against
19
Children) grant program;
20
. training of ICAC Task Force members and affiliate entities;
21
. grants for state and local law enforcement and prosecution agencies; and
22
. one new civilian investigative technician to assist with the ICAC unit
23
operations; and
24
. appropriates monies to the State Commission on Criminal and Juvenile Justice for
25
grants for approved education programs to help prevent the sexual exploitation of
26
children and requires certain reporting.

Monies Appropriated in this Bill:

This bill appropriates from the General Fund as follows:
29
. to the Office of the Attorney General as an ongoing appropriation subject to future
30
budget constraints, $273,250 for fiscal year 2007-08; and
31
. to the State Commission on Criminal and Juvenile Justice as an ongoing
32
appropriation subject to future budget constraints, $1,000,000 for fiscal year
33
2007-08.

Be it enacted by the Legislature of the state of Utah:

Section 1. Appropriation.
41
(1) As an ongoing appropriation subject to future budget constraints, there is
42
appropriated from the General Fund for fiscal year 2007-08, $273,250 to the Office of the
43
Attorney General.

(2) As an ongoing appropriation subject to future budget constraints, there is
45
appropriated from the General Fund for fiscal year 2007-08, $1,000,000 to the State
46
Commission on Criminal and Juvenile Justice.

(3) It is the intent of the Legislature that the monies appropriated under Subsection (1)
48
be used to fund prosecution and investigatory activities that may lead to an enforcement action
49
by the attorney general as follows:
50
(a) $38,250 for the replacement of federal funding cuts to the ICAC (Internet Crimes
51
Against Children) grant program from the last two years;
52
(b) $30,000 for training of ICAC Task Force members and affiliate entities;
53
(c) $150,000 as grants, allocated and administered by the attorney general, for the
54
expansion of affiliate ICAC entities for state and local law enforcement and prosecution
55
agencies that submit an application approved by the attorney general; and
56
(d) $55,000 for one new civilian investigative technician assigned to assist with the
57
ICAC unit created under Section
67-5-21
.

(4) It is the intent of the Legislature that the monies appropriated under Subsection (2)
59
be used for grants for approved education programs to help prevent the sexual exploitation of
60
children in accordance with Subsection
63-25a-104
(13) and that the Commission on Criminal
61
and Juvenile Justice make a report annually to the Executive Offices and Criminal Justice
62
Appropriations Subcommittee on the use of the monies.
