10 General Description:
11 This bill provides a class size cap in kindergarten through the third grade.
12 Highlighted Provisions:
13 This bill:
14 . provides a class size cap in kindergarten through the third grade; and
15 . requires the Legislature to provide for an annual adjustment in the appropriation for
16 class size reduction.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 53A-17a-124.8 is enacted to read:

27 53A-17a-124.8. Class size restrictions -- K-3.

28 (1) Except as provided in Subsection (2), the state's public schools may not have a
29 class size in kindergarten through the third grade that exceeds 20 students.
30 (2) Notwithstanding Subsection (1), a public school may have a class size in
31 kindergarten through the third grade that exceeds 20 students, but does not exceed 22 students
32 in kindergarten through the third grade if that school has no more than two classes in each
33 grade for kindergarten through the third grade.
34 (3) The Legislature shall provide for an annual adjustment in the appropriation for
35 class size reduction authorized under Section 53A-17a-124.5 to meet the requirements under
36 this section.
37 Section 2. Effective date.
38 This bill takes effect on July 1, 2007.
