             9      General Description:
             10          This bill creates an ombudsman for the Children's Health Insurance Program.
             11      Highlighted Provisions:
             12          This bill:
             13          .    creates the position of ombudsman for the Children's Health Insurance Program;
             14      and
             15          .    specifies the duties of the ombudsman.
             16      Monies Appropriated in this Bill:
             17          None
             18      Other Special Clauses:
             19          This bill takes effect on July 1, 2007.
             20      Utah Code Sections Affected:
             21      ENACTS:
             22          26-40-109.5, Utah Code Annotated 1953

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 26-40-109.5 is enacted to read:
             26          26-40-109.5. Program ombudsman.
             27          (1) (a) There is created within the department the position of Utah Children's Health


             28      Insurance Program Ombudsman.
             29          (b) The ombudsman shall be appointed by and shall serve at the pleasure of the
             30      executive director.
             31          (2) The ombudsman shall:
             32          (a) develop and maintain expertise and understanding of the program;
             33          (b) assist the public and enrollees of the program with:
             34          (i) eligibility determinations; and
             35          (ii) resolution of claims or coverage disputes;
             36          (c) educate the public and enrollees about the services of the ombudsman;
             37          (d) investigate complaints regarding the program;
             38          (e) notify complainants and the department regarding:
             39          (i) a decision to investigate or not investigate a complaint; and
             40          (ii) the results of investigations; and
             41          (f) make written recommendations, if any, to the department regarding procedures or
             42      policies of the program.
             43          Section 2. Effective date.
             44          This bill takes effect on July 1, 2007.
