General Description:

This bill allows the use of money from the Olene Walker Housing Loan Fund to assist a
10
displaced mobile home owner in relocating.

Highlighted Provisions:

This bill:

. allows the use of money from the Olene Walker Housing Loan Fund to assist a
14
displaced mobile home owner in relocating when the owner is displaced because of
15
a change in land use of the mobile home park; and
16
. makes technical changes.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
9-4-705
is amended to read:
27
9-4-705. Activities authorized to receive fund moneys -- Powers of the executive
28
director.
29
At the direction of the board, the executive director may:
30
(1) provide fund moneys to any of the following activities:
31
(a) acquisition, rehabilitation, or new construction of low-income housing units;
32
(b) matching funds for social services projects directly related to providing housing for
33
special-need renters in assisted projects;
34
(c) the development and construction of accessible housing designed for low-income
35
persons;
36
(d) shelters and transitional housing for the homeless; [and]
37
(e) other activities that will assist in improving the availability or quality of housing in
38
the state for low-income persons; and
39
(f) assisting a mobile home owner with relocation expenses if the owner has been a
40
resident of the mobile home park for more than one year and is displaced by a change in land
41
use of the mobile home park; and
42
(2) do any act necessary or convenient to the exercise of the powers granted by this part
43
or reasonably implied therefrom including:
44
(a) making or executing contracts and other instruments necessary or convenient for
45
the performance of the executive director and board's duties and the exercise of the executive
46
director and board's powers and functions under this part, including contracts or agreements for
47
the servicing and originating of mortgage loans;
48
(b) procuring insurance against any loss in connection with property or other assets
49
held by the fund, including mortgage loans, in amounts and from insurers it considers
50
desirable;
51
(c) entering into agreements with any department, agency, or instrumentality of the
52
United States or this state and with mortgagors and mortgage lenders for the purpose of
53
planning and regulating and providing for the financing and refinancing, purchase,
54
construction, reconstruction, rehabilitation, leasing, management, maintenance, operation, sale,
55
or other disposition of any residential housing undertaken with the assistance of the department
56
under this part;
57
(d) proceeding with a foreclosure action, to own, lease, clear, reconstruct, rehabilitate,
58
repair, maintain, manage, operate, assign, encumber, sell, or otherwise dispose of any real or
59
personal property obtained by the fund due to the default on any mortgage loan held by the
60
fund in preparation for disposition of the property, taking assignments of leases and rentals,
61
proceeding with foreclosure actions, and taking other actions necessary or incidental to the
62
performance of its duties; and
63
(e) selling, at a public or private sale, with public bidding, any mortgage or other
64
obligation held by the fund.
