             8      LONG TITLE
             9      General Description:
             10          This bill modifies provisions relating to applied technology education, including
             11      merging the Southeast Applied Technology College with the College of Eastern Utah.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides definitions;
             15          .    requires specific parental notification and consent before public education students
             16      may participate in the clinical portion of medical applied technology education;
             17          .    removes the Southeast Applied Technology College from the Utah College of
             18      Applied Technology and transfers its functions and responsibilities to the College of
             19      Eastern Utah;
             20          .    provides tuition uniformity for duplicate programs;
             21          .    creates an applied technology advisory committee at the College of Eastern Utah
             22      and specifies its membership and duties;
             23          .    modifies applied technology education reporting provisions; and
             24          .    makes technical corrections.

             44      Be it enacted by the Legislature of the state of Utah:
             45          Section 1. Section 53A-15-202 is amended to read:
             46           53A-15-202. Powers of the board.
             47          The State Board of Education:
             48          (1) shall establish minimum standards for applied technology programs in the public
             49      education system;
             50          (2) may apply for, receive, administer, and distribute funds made available through
             51      programs of federal and state governments to promote and aid applied technology education;
             52          (3) shall cooperate with federal and state governments to administer programs which
             53      promote and maintain applied technology education;
             54          (4) shall cooperate with the Utah College of Applied Technology to ensure that
             55      students in the public education system have access to applied technology education at Utah
             56      College of Applied Technology campuses; [and]
             57          (5) shall require that before a student may participate in the clinical portion of medical
             58      applied technology education, the student's parent or legal guardian has:


             59          (a) been first given written notice of the contents of the clinical program, including a
             60      description of specific potential student interactions with patients and specific medical
             61      procedures that may be witnessed or performed; and
             62          (b) provided specific written consent for the student's participation in the program; and
             63          [(5)] (6) shall, after consulting with local school districts, prepare and submit an annual
             64      report to the governor and to the Legislature's Education Interim Committee by October 31 of
             65      each year detailing:
             66          (a) how the applied technology education needs of secondary students are being met;
             67      and
             68          (b) what access secondary students have to programs offered:
             69          (i) at applied technology colleges; and
             70          (ii) within the [region] regions served by Snow College and the College of Eastern
             71      Utah.
             72          Section 2. Section 53B-2a-101 is amended to read:
             73           53B-2a-101. Definitions.
             74          As used in this chapter:
             75          (1) "Applied technology education" means organized educational programs offering
             76      sequences of courses or skill sets directly related to preparing individuals for paid or unpaid
             77      employment in current or emerging occupations that do not require a baccalaureate or advanced
             78      degree.
             79          (2) "Board of trustees" means the Utah College of Applied Technology Board of
             80      Trustees.
             81          (3) "College campus" means a college campus of the Utah College of Applied
             82      Technology.
             83          (4) "Competency-based" means mastery of subject matter or skill level, as
             84      demonstrated through business and industry approved standards and assessments, achieved
             85      through participation in a hands-on learning environment, and which is tied to observable,
             86      measurable performance objectives.
             87          (5) "High wage jobs" means jobs with an annual salary at or above the median salary in
             88      the service region of the college campus.
             89          [(5)] (6) "Open-entry, open-exit" means:


             90          (a) a method of instructional delivery that allows for flexible scheduling in response to
             91      individual student needs or requirements and demonstrated competency when knowledge and
             92      skills have been mastered; and
             93          (b) students have the flexibility to begin or end study at any time, progress through
             94      course material at their own pace, and demonstrate competency when knowledge and skills
             95      have been mastered. If competency is demonstrated in a program of study, a credential,
             96      certificate, diploma, or degree may be awarded.
             97          Section 3. Section 53B-2a-102 is amended to read:
             98           53B-2a-102. President -- Appointment -- Duties.
             99          (1) (a) The board shall appoint a president for the Utah College of Applied
             100      Technology.
             101          (b) The president of the Utah College of Applied Technology does not need to have a
             102      doctorate degree, but shall have extensive experience in applied technology education.
             103          (c) The president shall serve at the board's discretion.
             104          (d) The names of the final candidates for president of the Utah College of Applied
             105      Technology shall be publicly disclosed.
             106          (e) The chair and vice chair of the Utah College of Applied Technology Board of
             107      Trustees shall be members of the search committee for the president.
             108          (2) The president shall:
             109          (a) direct the Utah College of Applied Technology and coordinate the activities of each
             110      of its college campuses;
             111          (b) in cooperation with the board of trustees and with the approval of the board,
             112      develop a competency-based associate of applied technology degree;
             113          (c) ensure that, pursuant to State Board of Regents' rules, an applied technology
             114      education degree is primarily a terminal degree, but is transferable to a bachelor's degree in
             115      applied technology at other higher education institutions under specific articulation agreements;
             116          (d) in consultation with the board of trustees, campus presidents, and campus boards of
             117      directors, prepare a comprehensive strategic plan for delivering applied technology education
             118      through the Utah College of Applied Technology college campuses;
             119          (e) after consulting with local school districts and other higher education institutions in
             120      the regions, ensure that the curricula of the Utah College of Applied Technology meet the


             121      needs of the state, the regions, and the local school districts;
             122          (f) in consultation with the board of trustees, campus presidents, and campus boards of
             123      directors, and after consulting with local school districts and other higher education institutions
             124      in the region, develop strategies for providing applied technology education in rural areas,
             125      specifically considering the distances between rural applied technology education providers;
             126          (g) establish minimum standards for applied technology programs of the Utah College
             127      of Applied Technology college campuses;
             128          (h) in conjunction with the board of trustees, do the following:
             129          (i) develop and implement a system of common definitions, standards, and criteria for
             130      tracking and measuring the effectiveness of applied technology education;
             131          (ii) maintain a central administration office for coordination, prioritization, support,
             132      and reporting of college functions dealing with:
             133          (A) budgets and audits;
             134          (B) facilities, including capital, capital development, and leases;
             135          (C) management information systems;
             136          (D) campus and college master planning efforts;
             137          (E) strategic planning;
             138          (F) legislative and Board of Regents contact;
             139          (G) general data collection; and
             140          (H) programs, certificates, and curriculum; and
             141          (iii) develop and implement a plan to inform citizens about the availability, cost, and
             142      advantages of applied technology education;
             143          (i) after consulting with the State Board of Education and local school districts, ensure
             144      that secondary students in the public education system have access to applied technology
             145      education through the Utah College of Applied Technology college campuses; and
             146          (j) provide expertise and monitor applied technology education within the [region]
             147      regions served by Snow College and the College of Eastern Utah in accordance with [Section]
             148      Sections 53B-16-205 and 53B-16-207 .
             149          Section 4. Section 53B-2a-103 is amended to read:
             150           53B-2a-103. Utah College of Applied Technology Board of Trustees --
             151      Membership -- Terms -- Vacancies -- Oath -- Officers -- Quorum -- Committees --


             152      Compensation.
             153          (1) There is created the Utah College of Applied Technology Board of Trustees,
             154      composed of the following members:
             155          (a) two members of the State Board of Education appointed by the governor with the
             156      consent of the Senate;
             157          (b) two members of the State Board of Regents appointed by the governor with the
             158      consent of the Senate;
             159          (c) one member representing business and industry from the regional board of each
             160      regional applied technology college appointed by a majority vote of the business and industry
             161      members of the regional board;
             162          (d) one member representing business and industry from the Snow College applied
             163      technology advisory committee appointed by a majority of the business and industry members
             164      of the advisory committee; [and]
             165          (e) one member representing business and industry from the College of Eastern Utah
             166      applied technology advisory committee appointed by a majority of the business and industry
             167      members of the advisory committee; and
             168          [(e)] (f) one business or industry representative appointed by the governor with the
             169      consent of the Senate from nominations submitted by the speaker of the House of
             170      Representatives and president of the Senate.
             171          (2) (a) [Except as provided in Subsection (2)(b), the] The members of the board of
             172      trustees shall be appointed commencing on September 1 of the year of appointment to:
             173          (i) two-year terms for the members described in Subsections (1)(a) and (b); and
             174          (ii) four-year terms for the members described in Subsections (1)(c) [and (d)] through
             175      (f).
             176          [(b) At the first meeting of the board of trustees:]
             177          [(i) the members described in Subsections (1)(c) and (d) shall divide up their positions
             178      so that approximately half of them serve for initial two-year terms; and]
             179          [(ii) the members described in Subsections (1)(a) and (b) shall divide up their positions
             180      so that approximately half of them serve for initial one-year terms.]
             181          [(c)] (b) An appointed member holds office until a successor is appointed and
             182      qualified.


             183          (3) When a vacancy occurs in the membership for any reason, the replacement shall be
             184      appointed for the unexpired term.
             185          (4) (a) Each member shall take the official oath of office prior to assuming the office.
             186          (b) The oath shall be filed with the Division of Archives and Records Services.
             187          (5) The board of trustees shall elect a chair and vice chair, who serve for two years and
             188      until their successors are elected and qualified.
             189          (6) (a) The board of trustees may enact bylaws for its own government, including
             190      provision for regular meetings.
             191          (b) (i) The board of trustees may provide for an executive committee in its bylaws.
             192          (ii) If established, the committee shall have full authority of the board of trustees to act
             193      upon routine matters during the interim between board of trustees meetings.
             194          (iii) The committee may act on nonroutine matters only under extraordinary and
             195      emergency circumstances.
             196          (iv) The committee shall report its activities to the board of trustees at its next regular
             197      meeting following the action.
             198          (c) Copies of the board of trustees' bylaws shall be filed with the Board of Regents.
             199          (7) A quorum shall be required to conduct business which shall consist of a majority of
             200      board of trustee members.
             201          (8) The board of trustees may establish advisory committees.
             202          (9) (a) (i) Members who are not government employees shall receive no compensation
             203      or benefits for their services, but may receive per diem and expenses incurred in the
             204      performance of the member's official duties at the rates established by the Division of Finance
             205      under Sections 63A-3-106 and 63A-3-107 .
             206          (ii) Members may decline to receive per diem and expenses for their service.
             207          (b) (i) State government officer and employee members who do not receive salary, per
             208      diem, or expenses from their agency for their service may receive per diem and expenses
             209      incurred in the performance of their official duties from the board of trustees at the rates
             210      established by the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             211          (ii) State government officer and employee members may decline to receive per diem
             212      and expenses for their service.
             213          (c) (i) Higher education members who do not receive salary, per diem, or expenses


             214      from the entity that they represent for their service may receive per diem and expenses incurred
             215      in the performance of their official duties from the board of trustees at the rates established by
             216      the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             217          (ii) Higher education members may decline to receive per diem and expenses for their
             218      service.
             219          Section 5. Section 53B-2a-104 is amended to read:
             220           53B-2a-104. Utah College of Applied Technology Board of Trustees -- Powers
             221      and duties.
             222          The Utah College of Applied Technology Board of Trustees shall:
             223          (1) in cooperation with the president of the Utah College of Applied Technology, and
             224      with the approval of the State Board of Regents, develop competency-based associate of
             225      applied technology degrees to be offered by the Utah College of Applied Technology;
             226          (2) approve the courses and requirements for the associate of applied technology
             227      degrees;
             228          (3) ensure that, pursuant to State Board of Regents' rules, an applied technology
             229      education degree is primarily a terminal degree, but is transferable to a bachelor's degree in
             230      applied technology at other higher education institutions under specific articulation agreements;
             231          (4) ensure that the Utah College of Applied Technology college campuses comply with
             232      the requirements in Section 53B-2a-106 ;
             233          (5) advise the president of the Utah College of Applied Technology and the State
             234      Board of Regents on issues related to applied technology education;
             235          (6) receive budget requests from each college campus, compile and prioritize the
             236      requests, and submit the request to:
             237          (a) the Legislature; and
             238          (b) the Governor's Office of Planning and Budget;
             239          (7) receive funding requests pertaining to capital facilities and land purchases from
             240      each college campus, ensure that the requests comply with Section 53B-2a-112 , prioritize the
             241      requests, and submit the prioritized requests to the State Building Board;
             242          (8) prepare and submit an annual report detailing its progress and recommendations on
             243      applied technology education issues to the governor and to the Legislature's Education Interim
             244      Committee by October 31 of each year, which shall include information detailing:


             245          (a) how the applied technology education needs of secondary students are being met;
             246      and
             247          (b) what access secondary students have to programs offered:
             248          (i) at college campuses; and
             249          (ii) within the [region] regions served by Snow College and the College of Eastern
             250      Utah;
             251          (9) receive, by September 30 of each year, an annual report from Snow College and the
             252      College of Eastern Utah on the status of and maintenance of the effort for applied technology
             253      education in the [region] regions served by Snow College and the College of Eastern Utah,
             254      including access to open-entry, open-exit competency-based applied technology education
             255      programs at the tuition rate approved by the Utah College of Applied Technology for adults
             256      and at no tuition cost to secondary students; and
             257          (10) perform other duties and responsibilities prescribed under the policies of the State
             258      Board of Regents.
             259          Section 6. Section 53B-2a-105 is amended to read:
             260           53B-2a-105. Utah College of Applied Technology -- Composition.
             261          The Utah College of Applied Technology is composed of the following college
             262      campuses:
             263          (1) the Bridgerland Applied Technology College Campus which serves the geographic
             264      area encompassing:
             265          (a) the Box Elder School District;
             266          (b) the Cache School District;
             267          (c) the Logan School District; and
             268          (d) the Rich School District;
             269          (2) the Ogden-Weber Applied Technology College Campus which serves the
             270      geographic area encompassing:
             271          (a) the Ogden City School District; and
             272          (b) the Weber School District;
             273          (3) the Davis Applied Technology College Campus which serves the geographic area
             274      encompassing:
             275          (a) the Davis School District; and


             276          (b) the Morgan School District;
             277          (4) the Salt Lake/Tooele Applied Technology College Campus which serves the
             278      geographic area encompassing:
             279          (a) the Salt Lake City School District;
             280          (b) the Granite School District;
             281          (c) the Jordan School District;
             282          (d) the Murray School District; and
             283          (e) the Tooele School District;
             284          (5) the Mountainland Applied Technology College Campus which serves the
             285      geographic area encompassing:
             286          (a) the Alpine School District;
             287          (b) the Nebo School District;
             288          (c) the Provo School District;
             289          (d) the South Summit School District;
             290          (e) the North Summit School District;
             291          (f) the Wasatch School District; and
             292          (g) the Park City School District;
             293          (6) the Uintah Basin Applied Technology College Campus which serves the
             294      geographic area encompassing:
             295          (a) the Daggett School District;
             296          (b) the Duchesne School District; and
             297          (c) the Uintah School District;
             298          (7) the Southwest Applied Technology College Campus which serves the geographic
             299      area encompassing:
             300          (a) the Beaver School District;
             301          (b) the Garfield School District;
             302          (c) the Iron School District; and
             303          (d) the Kane School District; and
             304          (8) the Dixie Applied Technology College Campus which serves the geographic area
             305      encompassing the Washington School District[; and].
             306          [(9) the Southeast Applied Technology College Campus which serves the geographic


             307      area encompassing:]
             308          [(a) the Carbon School District;]
             309          [(b) the Emery School District;]
             310          [(c) the Grand School District; and]
             311          [(d) the San Juan School District.]
             312          Section 7. Section 53B-2a-106 is amended to read:
             313           53B-2a-106. College campuses -- Duties.
             314          (1) Each Utah College of Applied Technology college campus shall:
             315          (a) offer a post-secondary and extra-secondary applied technology education
             316      curriculum;
             317          (b) offer that curriculum at:
             318          (i) market cost to adult students, as approved by the board of trustees and the State
             319      Board of Regents; and
             320          (ii) no tuition to secondary students within the campus' jurisdiction;
             321          (c) provide applied technology education that will result in:
             322          (i) appropriate licensing, certification, or other evidence of completion of training; and
             323          (ii) qualification for [specific employment] high wage jobs in business and industry;
             324          (d) offer associate of applied technology degrees that have:
             325          (i) instruction provided in an open-entry, open-exit environment, except as required by
             326      external entities; and
             327          (ii) been reviewed by the board of trustees and approved by the State Board of Regents
             328      in accordance with Section 53B-1-103 ;
             329          (e) develop cooperative agreements with local school districts, other higher education
             330      institutions, businesses, industries, and community and private agencies to maximize the
             331      availability of instructional facilities; and
             332          (f) after consulting with local school districts within the geographic area served by the
             333      college campus:
             334          (i) ensure that secondary students in the public education system have access to applied
             335      technology education at each college campus; and
             336          (ii) prepare and submit an annual report to the Utah College of Applied Technology
             337      detailing:


             338          (A) how the applied technology education needs of secondary students within the
             339      region are being met; and
             340          (B) what access secondary students within the region have to programs offered at
             341      college campuses.
             342          (2) A college campus may offer a competency-based high school diploma approved by
             343      the State Board of Education in accordance with Section 53A-1-402 .
             344          (3) A college campus may not:
             345          (a) offer courses other than applied technology education and preparatory instruction in
             346      areas such as reading and mathematics that are necessary for student success in a chosen
             347      applied technology education or job-related program;
             348          (b) offer a degree other than an associate of applied technology degree approved by the
             349      State Board of Regents in accordance with Section 53B-1-103 ;
             350          (c) provide tenure or academic rank for its instructors; and
             351          (d) participate in intercollegiate athletics.
             352          (4) (a) The mission of a college campus is limited to applied technology education and
             353      may not expand to include credit-based academic programs typically offered by community
             354      colleges or other institutions of higher education.
             355          (b) A college campus may not offer a noncredit academic program that is offered by
             356      another higher education institution that is located in the campus service region unless the
             357      college campus charges the same or greater tuition than the other higher education institution.
             358          (c) In addition to requirements in Subsections (1)(b)(i) and (4)(b), tuition for noncredit
             359      programs offered by a college campus that duplicate programs offered by another institution of
             360      higher education that is located in the campus service region shall be approved by the campus
             361      board of directors and the State Board of Regents.
             362          (5) Each campus shall be recognized as a college campus of the Utah College of
             363      Applied Technology, and regional affiliation shall be retained and recognized through local
             364      designations such as "Bridgerland Applied Technology College: A Utah College of Applied
             365      Technology Campus."
             366          Section 8. Section 53B-2a-108 is amended to read:
             367           53B-2a-108. Campus boards of directors -- Membership -- Appointments.
             368          Each campus shall have a campus board of directors appointed as follows:


             369          (1) the Bridgerland Applied Technology College Campus Board of Directors shall be
             370      composed of the following 13 members:
             371          (a) one elected local school board member appointed by the board of education for the
             372      Box Elder School District;
             373          (b) one elected local school board member appointed by the board of education for the
             374      Cache School District;
             375          (c) one elected local school board member appointed by the board of education for the
             376      Logan School District;
             377          (d) one elected local school board member appointed by the board of education for the
             378      Rich School District;
             379          (e) one member of the Utah State University board of trustees;
             380          (f) one member of the State Board of Regents designated by the chair of the State
             381      Board of Regents to serve a one-year term; and
             382          (g) seven representatives of business or industry within the region appointed jointly by
             383      the members appointed under Subsections (1)(a) through (f);
             384          (2) the Ogden-Weber Applied Technology College Campus Board of Directors shall be
             385      composed of the following 11 members:
             386          (a) one elected local school board member appointed by the board of education for the
             387      Ogden City School District;
             388          (b) one elected local school board member appointed by the board of education for the
             389      Weber School District;
             390          (c) one elected local school board member jointly appointed by the boards of education
             391      for the Ogden City School District and the Weber School District;
             392          (d) one member of the Weber State University board of trustees;
             393          (e) one member of the State Board of Regents designated by the chair of the State
             394      Board of Regents to serve a one-year term; and
             395          (f) six representatives of business or industry within the region appointed jointly by the
             396      members appointed under Subsections (2)(a) through (e);
             397          (3) the Davis Applied Technology College Campus Board of Directors shall be
             398      composed of the following 11 members:
             399          (a) one elected local school board member appointed by the board of education for the


             400      Davis School District;
             401          (b) one elected local school board member appointed by the board of education for the
             402      Morgan School District;
             403          (c) one elected local school board member jointly appointed by the boards of education
             404      for the Davis School District and the Morgan School District;
             405          (d) one member of the Weber State University board of trustees;
             406          (e) one member of the State Board of Regents designated by the chair of the State
             407      Board of Regents to serve a one-year term; and
             408          (f) six representatives of business or industry within the region appointed jointly by the
             409      members appointed under Subsections (3)(a) through (e);
             410          (4) the Salt Lake/Tooele Applied Technology College Campus Board of Directors shall
             411      be composed of the following 15 members:
             412          (a) one elected local school board member appointed by the board of education for the
             413      Salt Lake City School District;
             414          (b) one elected local school board member appointed by the board of education for the
             415      Granite School District;
             416          (c) one elected local school board member appointed by the board of education for the
             417      Jordan School District;
             418          (d) one elected local school board member appointed by the board of education for the
             419      Murray School District;
             420          (e) one elected local school board member appointed by the board of education for the
             421      Tooele School District;
             422          (f) one member of the Salt Lake Community College board of trustees;
             423          (g) one member of the State Board of Regents designated by the chair of the State
             424      Board of Regents to serve a one-year term; and
             425          (h) eight representatives of business or industry within the region appointed jointly by
             426      the members appointed under Subsections (4)(a) through (g);
             427          (5) the Mountainland Applied Technology College Campus Board of Directors shall be
             428      composed of the following 19 members:
             429          (a) one elected local school board member appointed by the board of education for the
             430      Alpine School District;


             431          (b) one elected local school board member appointed by the board of education for the
             432      Nebo School District;
             433          (c) one elected local school board member appointed by the board of education for the
             434      Provo School District;
             435          (d) one elected local school board member appointed by the board of education for the
             436      South Summit School District;
             437          (e) one elected local school board member appointed by the board of education for the
             438      North Summit School District;
             439          (f) one elected local school board member appointed by the board of education for the
             440      Wasatch School District;
             441          (g) one elected local school board member appointed by the board of education for the
             442      Park City School District;
             443          (h) one member of the Utah Valley State College board of trustees;
             444          (i) one member of the State Board of Regents designated by the chair of the State
             445      Board of Regents to serve a one-year term; and
             446          (j) ten representatives of business or industry within the region appointed jointly by the
             447      members appointed under Subsections (5)(a) through (i);
             448          (6) the Uintah Basin Applied Technology College Campus Board of Directors shall be
             449      composed of the following 11 members:
             450          (a) one elected local school board member appointed by the board of education for the
             451      Daggett School District;
             452          (b) one elected local school board member appointed by the board of education for the
             453      Duchesne School District;
             454          (c) one elected local school board member appointed by the board of education for the
             455      Uintah School District;
             456          (d) one member of the Utah State University board of trustees;
             457          (e) one member of the State Board of Regents designated by the chair of the State
             458      Board of Regents to serve a one-year term; and
             459          (f) six representatives of business or industry within the region appointed jointly by the
             460      members appointed under Subsections (6)(a) through (e);
             461          (7) the Southwest Applied Technology College Campus Board of Directors shall be


             462      composed of the following 13 members:
             463          (a) one elected local school board member appointed by the board of education for the
             464      Beaver School District;
             465          (b) one elected local school board member appointed by the board of education for the
             466      Garfield School District;
             467          (c) one elected local school board member appointed by the board of education for the
             468      Iron School District;
             469          (d) one elected local school board member appointed by the board of education for the
             470      Kane School District;
             471          (e) one member of the Southern Utah University board of trustees;
             472          (f) one member of the State Board of Regents designated by the chair of the State
             473      Board of Regents to serve a one-year term; and
             474          (g) seven representatives of business or industry within the region appointed jointly by
             475      the members appointed under Subsections (7)(a) through (f);
             476          (8) the Dixie Applied Technology College Campus Board of Directors shall be
             477      composed of the following 11 members:
             478          (a) three elected local school board members appointed by the board of education for
             479      the Washington School District;
             480          (b) one member of the Dixie State College of Utah board of trustees;
             481          (c) one member of the State Board of Regents designated by the chair of the State
             482      Board of Regents to serve a one-year term; and
             483          (d) six representatives of business or industry within the region appointed jointly by the
             484      members appointed under Subsections (8)(a) through (c); and
             485          [(9) the Southeast Applied Technology College Campus Board of Directors shall be
             486      composed of the following 13 members:]
             487          [(a) one elected local school board member appointed by the board of education for the
             488      Carbon School District;]
             489          [(b) one elected local school board member appointed by the board of education for the
             490      Emery School District;]
             491          [(c) one elected local school board member appointed by the board of education for the
             492      Grand School District;]


             493          [(d) one elected local school board member appointed by the board of education for the
             494      San Juan School District;]
             495          [(e) one member of the College of Eastern Utah board of trustees;]
             496          [(f) one member of the State Board of Regents designated by the chair of the State
             497      Board of Regents to serve a one-year term; and]
             498          [(g) seven representatives of business or industry within the region appointed jointly by
             499      the members appointed under Subsections (9)(a) through (f); and]
             500          [(10)] (9) the representatives of business or industry shall be appointed jointly by the
             501      designated members from a list of names provided by local organizations or associations whose
             502      members employ workers with applied technology education.
             503          Section 9. Section 53B-16-201 is amended to read:
             504           53B-16-201. Degrees and certificates that may be conferred.
             505          (1) [Utah Valley State College] The College of Eastern Utah, Snow College, and Salt
             506      Lake Community College may confer certificates of completion and degrees as determined by
             507      the State Board of Regents.
             508          (2) The board shall develop evaluative criteria as a means of carefully monitoring the
             509      impact of degree programs on the vocational mission of the colleges.
             510          Section 10. Section 53B-16-207 is enacted to read:
             511          53B-16-207. College of Eastern Utah -- Applied technology education --
             512      Supervision and administration -- Transition -- Institutional mission.
             513          (1) The College of Eastern Utah shall:
             514          (a) maintain a strong curriculum in applied technology and technical courses at its
             515      campus and within the region it serves which can be transferred to other institutions within the
             516      higher education system, together with lower division courses and courses required for
             517      associate degrees in science, arts, applied science, and applied technology;
             518          (b) work with local school districts in developing an aggressive concurrent enrollment
             519      program; and
             520          (c) provide for open-entry, open-exit competency-based applied technology education
             521      programs, at the tuition rate approved by the Utah College of Applied Technology for adults
             522      and at no tuition cost to secondary students, that emphasize short-term job training or retraining
             523      for immediate placement in the job market and serve the geographic area encompassing:


             524          (i) the Carbon School District;
             525          (ii) the Emery School District;
             526          (iii) the Grand School District; and
             527          (iv) the San Juan School District.
             528          (2) The College of Eastern Utah may not exercise any jurisdiction over applied
             529      technology education provided by a local school district independently of the College of
             530      Eastern Utah.
             531          (3) The College of Eastern Utah shall report to the Utah College of Applied
             532      Technology by September 30 of each year on the status of and maintenance of the effort for
             533      applied technology education in the region served by the College of Eastern Utah, including
             534      access to open-entry, open-exit competency-based applied technology education programs at
             535      the tuition rate approved by the Utah College of Applied Technology for adults and at no
             536      tuition cost to secondary students.
             537          Section 11. Section 53B-16-208 is enacted to read:
             538          53B-16-208. The College of Eastern Utah -- Applied technology advisory
             539      committee -- Membership -- Duties.
             540          (1) The College of Eastern Utah shall have an applied technology advisory committee
             541      composed of the following 12 members:
             542          (a) one elected local school board member appointed by the board of education for the
             543      Carbon School District;
             544          (b) one elected local school board member appointed by the board of education for the
             545      Emery School District;
             546          (c) one elected local school board member appointed by the board of education for the
             547      Tintic School District;
             548          (d) one elected local school board member appointed by the board of education for the
             549      Grand School District;
             550          (e) one elected local school board member appointed by the board of education for the
             551      San Juan School District;
             552          (f) one member of the College of Eastern Utah board of trustees appointed by the
             553      president of the College of Eastern Utah; and
             554          (g) six representatives of business or industry within the region appointed by the


             555      president of the College of Eastern Utah from nominations of the members appointed under
             556      Subsections (1)(a) through (f).
             557          (2) The applied technology advisory committee shall:
             558          (a) after consulting with the College of Eastern Utah and school districts within its
             559      region, prepare a comprehensive strategic plan for delivering applied technology education
             560      within its region;
             561          (b) make recommendations regarding what skills are needed for employment in Utah
             562      businesses and industries;
             563          (c) recommend programs based upon the information gathered in accordance with
             564      Subsection (2)(b);
             565          (d) review annual program evaluations;
             566          (e) provide counsel, support, and recommendations for updating and improving the
             567      effectiveness of applied technology education programs and services, including expedited
             568      program approval and termination of procedures, consistent with Board of Regents' policy;
             569          (f) monitor program advisory committees and other advisory groups to provide
             570      counsel, support, and recommendations for updating and improving the effectiveness of
             571      training programs and services; and
             572          (g) coordinate with local school boards and districts to protect and enhance the applied
             573      technology education needs of secondary students.
             574          Section 12. Effective date.
             575          This bill takes effect on July 1, 2007.
