8 LONG TITLE
9 General Description:
10 This bill changes the duties of the Child Support Guidelines Advisory Committee to
11 include parent-time and custody issues.
12 Highlighted Provisions:

24 Be it enacted by the Legislature of the state of Utah:
25 Section 1. Section 78-45-7.13 is amended to read:
26 78-45-7.13. Advisory committee -- Membership and functions.
27 (1) On or before March 1, 2007 and then on or before March 1 of every fourth year

28 subsequently, the governor shall appoint an advisory committee consisting of:
29 (a) one representative recommended by the Office of Recovery Services;
30 (b) one representative recommended by the Judicial Council;
31 (c) two representatives recommended by the Utah State Bar Association;
32 (d) two representatives of noncustodial parents;
33 (e) two representatives of custodial parents;
34 (f) one representative with expertise in economics; and
35 (g) two representatives from diverse interests related to child support, custody, or
36 parent-time issues, as the governor may consider appropriate. However, none of the
37 individuals appointed under this Subsection may be members of the Utah State Bar
38 Association.
39 (2) The term of the committee members expires one month after the report of the
40 committee is submitted to the Legislature under Subsection (4).
41 (3) When a vacancy occurs in the membership for any reason, the replacement shall be
42 appointed for the unexpired term.
43 (4) (a) The advisory committee shall review [the] child support guidelines, custody,
44 and parent-time laws to ensure that their application results in [the determination of appropriate
45 child support award amounts] a seamless combination that works effectively for both parents
46 and children.
47 (b) The committee shall report to the Legislative Judiciary Interim Committee on or
48 before [October] November 1 in 2007 and then on or before [October] November 1 of every
49 fourth year subsequently.
50 (c) The committee's report shall include recommendations of the majority of the
51 committee, as well as specific recommendations of individual members of the committee.
52 (5) (a) (i) Members who are not government employees shall receive no compensation
53 or benefits for their services, but may receive per diem and expenses incurred in the
54 performance of the member's official duties at the rates established by the Division of Finance
55 under Sections 63A-3-106 and 63A-3-107 .
56 (ii) Members may decline to receive per diem and expenses for their service.
57 (b) (i) State government officer and employee members who do not receive salary, per
58 diem, or expenses from their agency for their service may receive per diem and expenses

59 incurred in the performance of their official duties from the committee at the rates established
60 by the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
61 (ii) State government officer and employee members may decline to receive per diem
62 and expenses for their service.
63 (6) Staff for the committee shall be provided from the existing budgets of the
64 Department of Human Services.
65 (7) The committee ceases to exist no later than [November 1, 2003] December 1, 2007
66 and then on [November] December 1 of every fourth year subsequently.
67 [(8) Any committee appointed by the governor prior to October 1, 2003 ceases to exist
68 on November 1, 2003.]
