General Description:

This bill authorizes members younger than 14 years old and adult volunteer leaders to
10
fish without a license during a youth organization activity.

Highlighted Provisions:

This bill:
13
. authorizes members younger than 14 years old and adult volunteer leaders to fish
14
during a youth organization activity without a fishing license if the organization
15
receives proper documentation;
16
. requires the adult leader to instruct the youth members on fishing laws;
17
. requires the Division of Wildlife Resources to provide educational materials on
18
fishing laws; and
19
. authorizes the Division of Wildlife Resources to make rules to implement this
20
section.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
23-19-14.5
is enacted to read:
31
23-19-14.5. Persons participating in youth organization activity authorized to fish
32
without license.
33
(1) As used in this section, "youth organization" means:
34
(a) the Boy Scouts of America;
35
(b) the Girls Scouts of the USA; or
36
(c) a nonprofit corporation, as defined in Section
16-6a-102
, that promotes character
37
building through outdoor activities.

(2) The Division of Wildlife Resources shall permit a person to fish without a license
39
during a youth organization activity if:
40
(a) the person is:
41
(i) (A) a member of a youth organization ; and
42
(B) younger than 14 years old; or
43
(ii) an adult volunteer leader of a youth organization;
44
(b) the fishing is in compliance with all fishing statutes and rules; and
45
(c) the adult volunteer leader obtains from the youth organization:
46
(i) a valid tour permit; or
47
(ii) official documentation that specifies:
48
(A) the date and place of the fishing;
49
(B) the name of any adult volunteer leader that will supervise the fishing; and
50
(C) that the activity is officially sanctioned by the youth organization.

(3) (a) The adult volunteer leader shall instruct the members on fishing statutes and
52
rules.

(b) The division shall provide educational materials on its website to assist the adult
54
volunteer leader in complying with Subsection (3)(a).

(4) By following the procedures and requirements of Tile 63, Chapter 46a,
56
Administrative Rulemaking Act, the Wildlife Board shall adopt rules specifying the form of the
57
official documentation required by Subsection (2)(c)(ii).
