8 General Description:
9 This bill amends the portion of the Utah Criminal Code related to sodomy.
10 Highlighted Provisions:
11 This bill:
12 . amends the sodomy provisions of the Utah Criminal Code to provide that
13 consensual sodomy involving adults is not a crime.

22 Be it enacted by the Legislature of the state of Utah:
23 Section 1. Section 76-5-403 is amended to read:
24 76-5-403. Sodomy -- Forcible sodomy.
25 (1) A person commits sodomy when the actor engages in any sexual act with a person
26 who is at least 14 years of age [or older], but younger than 18 years of age, involving the
27 genitals of one person and mouth or anus of another person, regardless of the sex of either

28 participant.
29 (2) A person commits forcible sodomy when the actor commits sodomy upon another
30 without the other's consent.
31 (3) Sodomy is a class B misdemeanor. Forcible sodomy is a felony of the first degree.
