LONG TITLE

General Description:

This bill addresses issues related to the 17th Amendment to the United States
15
Constitution and permits the Legislature to give direction to certain United States
16
Senators and to receive certain reports from them.

Highlighted Provisions:

This bill:
19
. allows the Legislature to give formal direction to a United States Senator elected
20
from Utah;
21
. allows the Legislature to direct a United States Senator elected from Utah to report
22
to the Legislature on certain issues determined by the Legislature;
23
. provides that any direction or reporting requirements be made by:
24
. a joint resolution of the Legislature; or
25
. a written statement, called "The Sense of the Legislature," that contains the
26
signatures of a majority of the members of the House and a majority of the
27
members of the Senate; and
28
. directs the Office of Legislative Research and General Counsel to maintain a record
29
of all resolutions, statements, and responses issued under this section.

Be it enacted by the Legislature of the state of Utah:

is enacted to read:

CHAPTER 27. LEGISLATIVE DIRECTION TO U.S. SENATORS ACT

36-27-101. Title.

This chapter is known as the "Legislative Direction to U.S. Senators Act."

Section 2.

36-27-102
is enacted to read:

36-27-102. Legislative direction to U.S. Senators.

(1) The Legislature may give direction to a United States Senator elected from Utah.
49
(2) The Legislature may direct a United States Senator elected from Utah to provide a
50
single response or periodic reports to the Legislature on:
51
(a) the senator's progress with the direction given under Subsection (1); or
52
(b) other issues as determined by the Legislature.

is enacted to read:

36-27-103. Resolution of the Legislature -- Statement providing sense of the
55
Legislature.

(1) The Legislature may provide any direction or reporting requirements under Section
57
36-27-102
by:
58
(a) passing a joint resolution of the Legislature; or
59
(b) issuing a written statement that contains the signatures of a majority of the
60
members of the House and a majority of the members of the Senate.

(2) A written statement under Subsection (1)(b) shall be referred to as "The Sense of
62
the Legislature."

is enacted to read:

36-27-104. Reporting requirements.

(1) A resolution or sense of the Legislature issued under this chapter shall specify that a
66
United States Senator elected from Utah shall provide the following to the Office of Legislative
67
Research and General Counsel when submitting a report in response to the resolution or sense
68
of the Legislature:
69
(a) prior notice of any verbal response or report; or
70
(b) a copy of any written response or report.

(2) The Office of Legislative Research and General Counsel shall maintain a record of:
72
(a) all resolutions and senses of the Legislature issued under this chapter; and
73
(b) all responses and reports provided to the Legislature by a United States Senator in
74
response to a resolution or sense of the Legislature issued under this chapter.
