General Description:

This joint resolution of the Legislature supports reauthorization of the Presidential
11
Trade Promotion Authority under certain conditions.

This resolution:

. supports reauthorization of the Presidential Trade Promotion Authority provided

that certain conditions impacting the state's interests are included.

Be it resolved by the Legislature of the state of Utah:
20
WHEREAS, the Presidential Trade Promotion Authority concerning international trade
21
agreements is set to expire on June 30, 2007; and
22
WHEREAS, the Legislature is concerned with international trade agreements' potential
23
negative impacts on state policy and state regulatory authority and practices:
24
NOW, THEREFORE, BE IT RESOLVED that the Legislature of the State of Utah
25
supports Congressional reauthorization of the Presidential Trade Promotion Authority,
26
provided that trade agreements negotiated under that authority:
27
(1) grant no greater rights, either substantive or procedural, to foreign investors than
28
those possessed by or granted to Utah residents;
29
(2) protect state police and regulatory authority;
30
(3) exempt state laws existing at the time of the agreement's adoption;
31
(4) utilize an opt-in process for making commitments concerning state-level
32
authorities or interests;
33
(5) fully indemnify the state for any monetary claims brought against the United
34
States under a trade agreement based on state action;
35
(6) require express congressional action to preempt state law necessary to comply
36
with a trade agreement;
37
(7) require reimbursement of state expenses incurred in a trade dispute;
38
(8) include enforceable labor and environmental standards; and
39
(9) be presented to the United States Trade Representative's Intergovernmental
40
Policy Advisory Committee immediately upon the conclusion of the first round
41
of negotiations.
