Mr. Speaker:

    The Law Enforcement and Criminal Justice Committee reports a favorable recommendation on H.B. 70, ASSAULT ON A PEACE OFFICER - PENALTY AMENDMENT, by Representative P. Ray, with the following amendments:

1.    Page 1, Line 10 :    

             10          This bill modifies the Criminal Code by increasing the penalty for

  a second offense of       assault on a peace


2.    Page 1, Line 14 :    

             14          .    increases the penalty for committing
{   an   }        a second or subsequent       assault against a peace officer from a class


3.    Page 2, Line 30 :    

             30          [(1)] (2)
  (a)       Any person who assaults a peace officer, with knowledge that he is a peace


4.    Page 2, Line 32 :    

             32      is guilty of a
{   [   } class A misdemeanor      {   ]   }      {   third degree felony   }        except as provided in Subsection (2)(b)       .

    
  (b) A person who violates this section after having been previously convicted of a violation of this section is guilty of a third degree felony.
