Mr. President:

    The Education Committee reports a favorable recommendation on S.B. 133, LOCAL SCHOOL BOARD PUBLIC HEARING REQUIREMENTS, by Senator P. Jones, with the following amendments:

1.    Page 6, Lines 159 through 161 :    

             159          (21) (a) Before closing a school or changing the boundaries of a school, a board shall:
             160          (i) hold a public hearing, as defined in Section

{   52-4-103   }        10-9a-103       ; and

             161          (ii) provide public notice of the public hearing, as specified in Subsection (21)(b).

2.    Page 6, Lines 176 through 178 :    

             176          (2) Prior to the adoption of a budget containing a tax rate which does not exceed the
             177      certified tax rate, the board shall hold a public hearing
  , as defined in Section 10-9a- 103,       on the proposed budget. In addition to

             178      complying with Title 52, Chapter 4, Open and Public Meetings Act, in regards to the hearing,
