General Description:

This bill modifies county and municipal land use development and management

provisions.

collection and restoration of collector vehicles if the vehicles are kept out of

ordinary public view.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
10-9a-522
is enacted to read:

10-9a-522. Automotive collection restrictions prohibited.

(1) As used in this section:

(a) "Automotive collection" means the collection and restoration of one or more
31
collector vehicles, whether as a hobby or profession, including the storing of H. [

(b) "Automotive collector" means a person engaged in automotive collection, whether

as a hobby or profession.

H. (c) "Collector vehicle" means a motor vehicle that is:

(i) 25 years old or older;

(ii) a limited production vehicle; or

(iii) a special interest vehicle.

] (d) .H "Ordinary public view" means within the natural visual range of an individual

on a

public street or sidewalk.

] (e) .H "Parts car" means a motor vehicle that is not intended to be operated on a

road but

is used to provide parts for the restoration of other motor vehicles.

(2) A municipality may not prohibit automotive collection, if the automotive collector

keeps each collector vehicle and parts car out of ordinary public view by:

(a) inside storage;

(b) fencing;

(c) trees or shrubbery H. that block the view year round .H ; or
44
(d) any other barrier.

(3) An automotive collector may perform mechanical repairs or modifications to a
46
vehicle located out of ordinary public view on private real property within a municipality.
