LONG TITLE

General Description:

This bill directs the Office of Legislative Research and General Counsel to complete a
12
study of all available remedies the state may have in seeking reimbursement from the
13
federal government for costs incurred by the state resulting from illegal immigration.

Highlighted Provisions:

This bill:

. directs the Office of Legislative Research and General Counsel to complete a study
17
of all available remedies to recover any moneys owing from the federal government
18
to the state for the reimbursement of costs incurred by the state resulting from illegal
19
immigration; and
20
. directs the Office of Legislative Research and General Counsel to file a written
21
report with the governor, the president of the Senate, the speaker of the House of
22
Representatives, and the chairs of the Executive Appropriations Committee that
23
details the findings of the study.

Be it enacted by the Legislature of the state of Utah:

Section 1. Study of available remedies for the recovery of federal reimbursement
33
for costs associated with illegal immigration -- Reported findings.

(1) The Legislature finds that:
35
(a) the costs incurred by the state in addressing illegal immigration have increased in
36
recent years;
37
(b) the areas in which these costs have been incurred include identifying illegal
38
immigrants, processing illegal immigrants through the criminal justice system, incarcerating
39
illegal immigrants, and providing education, medical assistance, health care, and foster care for
40
illegal immigrants;
41
(c) federal funding to assist states in dealing with illegal immigration has decreased; and
42
(d) the federal government is asking state governments to use more of their own funds
43
to enforce federal immigration laws and preserve homeland security, which are essentially
44
federal responsibilities.

(2) The Office of Legislative Research and General Counsel shall conduct a study and
46
review of all available state remedies to recover any moneys owing from the federal government
47
to the state for the reimbursement of costs incurred by the state resulting from illegal
48
immigration.

(3) On or before November 1, 2008, the Office of Legislative Research and General
50
Counsel shall file a written report with the governor, the president of the Senate, the speaker of
51
the House of Representatives, and the chairs of the Executive Appropriations Committee that
52
details the findings of the review and study together with available remedies and
53
recommendations as to how to best pursue a course of recovery of unpaid reimbursable costs
54
related to illegal immigration.
