11 This bill provides for stipends for special educators for additional days of work.
12 Highlighted Provisions:
13 This bill:
14 . directs the Legislature to annually appropriate money for stipends for special
15 educators in the amount of $200 per day for up to ten additional days of work; and
16 . requires special educators to:
17 . schedule the additional days of work before or after the school year; and
18 . use the additional days of work to perform duties related to the IEP process.

27 Be it enacted by the Legislature of the state of Utah:

28 Section 1. Section 53A-17a-154 is enacted to read:
29 53A-17a-154. Stipends for special educators for additional days of work.
30 (1) As used in this section:
31 (a) "IEP" means an individualized education program developed pursuant to the
32 Individuals with Disabilities Education Improvement Act of 2004, as amended.
33 (b) "Special education teacher" means a teacher whose primary assignment is the
34 instruction of students with disabilities who are eligible for special education services.
35 (c) "Special educator" means a person employed by a school district, charter school, or
36 the Utah Schools for the Deaf and the Blind who holds:
37 (i) a license issued under Title 53A, Chapter 6, Educator Licensing and Professional
38 Practices Act; and
39 (ii) a position as a:
40 (A) special education teacher; or
41 (B) speech-language pathologist.
42 (2) In recognition of the added duties and responsibilities assumed by special educators
43 to comply with federal law regulating the education of students with disabilities and the need to
44 attract and retain qualified special educators, the Legislature shall annually appropriate money
45 for stipends to special educators for additional days of work.
46 (3) The State Board of Education shall distribute money appropriated under this section
47 to school districts, charter schools, and the Utah Schools for the Deaf and the Blind for stipends
48 for special educators in the amount of $200 per day for up to ten additional working days.
49 (4) A special educator receiving a stipend shall:
50 (a) work an additional day beyond the number of days contracted with the special
51 educator's school district or school for each $200 daily stipend;
52 (b) schedule the additional days of work before or after the school year; and
53 (c) use the additional days of work to perform duties related to the IEP process,
54 including:
55 (i) administering student assessments;
56 (ii) conducting IEP meetings;
57 (iii) writing IEPs;
58 (iv) conferring with parents; and

59 (v) maintaining records and preparing reports.
60 (5) A special educator may:
61 (a) elect to receive a stipend for one to ten days of additional work; or
62 (b) elect to not receive a stipend.
63 (6) A person who does not hold a full-time position as a special educator is eligible for
64 a partial stipend equal to the percentage of a full-time special educator position the person
65 assumes.
