LONG TITLE

General Description:

This bill provides an appropriation for existing inmate postsecondary education.

Highlighted Provisions:

This bill:

. appropriates money to the State Board of Regents to distribute to institutions of
14
higher education that currently provide inmate postsecondary education under the
15
supervision of the Utah Department of Corrections;
16
. requires participating inmates to pay affordable tuition to help offset the state costs
17
of providing the education; and
18
. designates the appropriation as nonlapsing.

This bill appropriates:

. as an ongoing appropriation subject to future budget constraints, $1,500,000 from
22
the General Fund for fiscal year 2008-09 to the State Board of Regents.

Other Special Clauses:

This bill takes effect on July 1, 2008.

Be it enacted by the Legislature of the state of Utah:

Section 1. Appropriation.

(1) As an ongoing appropriation subject to future budget constraints, there is
31
appropriated from the General Fund for fiscal year 2008-09, $1,500,000 to the State Board of
32
Regents.

(2) It is the intent of the Legislature that the appropriation described under Subsection
34
(1) shall be distributed by the State Board of Regents to institutions of higher education that
35
provide inmate postsecondary education under the supervision of the Utah Department of
36
Corrections to:
37
(a) stabilize the funding of existing postsecondary education programs;
38
(b) primarily reimburse the personnel costs of providing the inmate postsecondary
39
education; and
40
(c) purchase necessary equipment and supplies for the inmate postsecondary education.

(3) It is the intent of the Legislature that the institutions of higher education that
42
provide inmate postsecondary education shall require participating inmates to pay affordable
43
tuition to help offset the state costs of providing the education.
44
(4) The appropriation described under Subsection (1) is nonlapsing.

Section 2. Effective date.

This bill takes effect on July 1, 2008.
