LONG TITLE

General Description:

This bill modifies provisions relating to the Utah College of Applied Technology and
11
applied technology education.
12
Highlighted Provisions:
13
This bill:
14
. requires at least 50% of funding requests for new capital facilities of the Utah
15
College of Applied Technology to be for facilities that are within reasonable
16
walking distance of a high school;
17
. requires an evaluation committee to study Utah College of Applied Technology and
18
applied technology education issues;
19
. specifies evaluation committee membership, responsibilities, and staff support; and
20
. requires the evaluation committee to report to the Education Interim Committee and
21
the Executive Appropriations Committee by November 30, 2008.

Be it enacted by the Legislature of the state of Utah:

Section 1.
Section
53B-2a-112
is amended to read:
32
53B-2a-112. College campuses -- Relationships with other public and higher
33
education institutions -- Agreements -- Priorities -- New capital facilities.
34
(1) As used in this section, "higher education institution" means, for each college
35
campus, the higher education institution designated in Section
53B-2a-108
, except for the State
36
Board of Regents, to have a representative on its campus board of directors.
37
(2) A college campus shall avoid any unnecessary duplication of applied technology
38
instructional facilities, programs, administration, and staff between the college campus and
39
other public and higher education institutions.
40
(3) A college campus may enter into agreements:
41
(a) with other higher education institutions to cultivate cooperative relationships;
42
(b) with other public and higher education institutions to enhance applied technology
43
education within its region; or
44
(c) to comply with Subsection (2).
45
(4) Before a college campus develops its own new instructional facilities, it shall give
46
priority to:
47
(a) maintaining its own existing instructional facilities for both secondary and adult
48
students;
49
(b) coordinating with the president of a higher education institution and entering into
50
any necessary agreements to provide applied technology education to both secondary and adult
51
students that:
52
(i) maintain and support existing higher education applied technology education
53
programs; and
54
(ii) maximize the use of existing higher education facilities; and
55
(c) developing cooperative agreements with local school districts, other higher
56
education institutions, businesses, industries, and community and private agencies to maximize
57
the availability of applied technology instructional facilities for both secondary and adult
58
students.

(5) (a) Before submitting a funding request pertaining to new capital facilities and land
60
purchases to the Utah College of Applied Technology, a college campus shall:
61
(i) ensure that all available instructional facilities are maximized in accordance with
62
Subsections (4)(a) through (c); and
63
(ii) coordinate the request with the president of a higher education institution, if
64
applicable.
65
(b) The State Building Board shall make a finding that the requirements of this section
66
are met before it may consider a funding request of the Utah College of Applied Technology
67
pertaining to new capital facilities and land purchases.
68
(c) A college campus may not construct, approve the construction of, plan for the
69
design or construction of, or consent to the construction of an applied technology education
70
facility without approval of the Legislature.
71
(6) Before acquiring new fiscal and administrative support structures, a college campus
72
shall:
73
(a) review the use of existing public or higher education administrative and accounting
74
systems, financial record systems, and student and financial aid systems for the delivery of
75
applied technology education in the region;
76
(b) determine whether it is feasible to use those existing systems; and
77
(c) with the approval of the campus board of directors and the board of trustees, use
78
those existing systems.

(7) (a) The higher education institution for the region shall have the first opportunity to
80
offer the general education courses that are required for an associate of applied technology
81
degree offered by the Utah College of Applied Technology, at the college campus site.
82
(b) The content of the general education courses described in Subsection (7)(a) shall be
83
defined by the higher education institution for the region in a manner consistent with the needs
84
of the Utah College of Applied Technology.
85
(c) If the higher education institution for the region is unable to offer the courses
86
described in Subsection (7)(a), other institutions of higher education may offer those courses.
87
(d) The college campuses shall be responsible to provide technical skills training and
88
basic skills as required by business and industry towards an associate of applied technology
89
degree.

(8) Beginning on July 1, 2008, at least 50% of new funding requests pertaining to new
91
capital facilities and land purchases for the Utah College of Applied Technology shall be for
92
facilities that will be located within reasonable walking distance of a public high school.
93
Section 2. Required studies.
94
(1) A study of Utah College of Applied Technology and applied technology education
95
issues shall be conducted as provided in this section.
96
(2) An evaluation committee shall be established with membership as follows:
97
(a) two members of the State Board of Regents, including at least one regent with
98
personal experience in applied technology education, selected by the State Board of Regents;
99
(b) two business and industry members of the Utah College of Applied Technology
100
Board of Trustees, selected by the Utah College of Applied Technology Board of Trustees; and
101
(c) one member appointed by the governor.

(3) The evaluation committee shall:
103
(a) study options for the elimination of duplicate programs, including:
104
(i) merging the Utah College of Applied Technology's Salt Lake/Tooele Campus with
105
the Salt Lake Community College;
106
(ii) developing strategic alliances;
107
(iii) merging the Utah College of Applied Technology's Salt Lake/Tooele Campus with
108
the Salt Lake Skills Center; and
109
(iv) merging the Utah College of Applied Technology's Salt Lake/Tooele Campus with
110
the Davis Applied Technology College Campus or the Ogden-Weber Applied Technology
111
College Campus;
112
(b) recommend budget transfers to eliminate windfalls for duplicate programs;
113
(c) recommend modifications to the current governance of the Utah College of Applied
114
Technology and applied technology education programs;
115
(d) evaluate the probable student transfers under the options; and
116
(e) study other issues related to the delivery of applied technology education in the
117
state that are of interest to the committee.

(4) The commissioner of higher education's staff shall provide staff support to the
119
evaluation committee.
120
(5) The evaluation committee shall report its study, including findings,
121
recommendations, and any proposed legislation, to the Education Interim Committee and the
122
Executive Appropriations Committee by November 30, 2008.

Section 3. Repeal date.
