             9      General Description:
             10          This bill provides a graduate tuition waiver for Purple Heart recipients under specified
             11      conditions.
             12      Highlighted Provisions:
             13          This bill:
             14          .    waives the graduate tuition at a state institution of higher education for Purple Heart
             15      recipients:
             16              .    for a maximum amount of money; and
             17              .    to be used in a certain time frame; and
             18          .    makes technical amendments.
             19      Monies Appropriated in this Bill:

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 53B-8e-103 is amended to read:
             29           53B-8e-103. Tuition waivers for Purple Heart recipients -- Qualifications --
             30      Limitations.
             31          (1) Beginning in the 2004-05 academic year, a state institution of higher education
             32      shall waive undergraduate tuition for each Purple Heart recipient who:
             33          (a) is admitted as a full-time, part-time, or summer school student in an undergraduate
             34      program of study leading to a degree or certificate;
             35          (b) is a resident student of the state as determined under Section 53B-8-102 ; and
             36          (c) submits verification as provided in Subsection [(2)] (3) that the student is a Purple
             37      Heart recipient.
             38          (2) (a) Beginning in the 2008-09 academic year, a state institution of higher education
             39      shall waive graduate tuition as provided in this Subsection (2) for each Purple Heart recipient
             40      who:
             41          (i) is admitted as a full-time, part-time, or summer school student in a graduate
             42      program of study leading to a degree;
             43          (ii) is a resident student of the state as determined under Section 53B-8-102 ; and
             44          (iii) submits verification as provided in Subsection (3) that the student is a Purple Heart
             45      recipient.
             46          (b) To qualify for a graduate tuition waiver, a Purple Heart recipient shall apply for a
             47      graduate program no later than ten years from the day on which the Purple Heart recipient
             48      completes an undergraduate degree.
             49          (c) The total amount of all graduate tuition waived for a Purple Heart recipient may not
             50      exceed $10,000.
             51          (d) A Purple Heart recipient may receive a graduate tuition waiver for a period of time
             52      that does not exceed the lesser of:
             53          (i) the time it takes for the Purple Heart recipient to complete a graduate degree; or
             54          (ii) five years after the day on which the Purple Heart recipient is accepted to a
             55      graduate program.
             56          [(2)] (3) A Purple Heart recipient seeking a tuition waiver shall request the Department
             57      of Veterans' Affairs to provide the verification required by Subsection (1)(c). The Department
             58      of Veterans' Affairs shall provide the verification upon obtaining evidence satisfactory to the


             59      division that the student is a Purple Heart recipient.
             60          (4) The State Board of Regents may request reimbursement from the Legislature for
             61      costs incurred in providing the tuition waiver under this section.
